K\u0131dem tazminat\u0131n\u0131n ko\u015fullar\u0131, hesab\u0131 ve \u00f6deme \u015fekli do\u011frudan yasalarla d\u00fczenlenmi\u015ftir.<\/span><\/p><p class=\"s6\"><span class=\"s5\">K\u0131dem tazminat\u0131, feshe ba\u011fl\u0131 haklardan olsa da, i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi her durumda talep hakk\u0131 do\u011fmamaktad\u0131r. 4857 Say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 120. maddesi uyar\u0131nca y\u00fcr\u00fcrl\u00fc\u011f\u00fc devam eden m\u00fclga 1475 Say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 14. maddesi h\u00fck\u00fcmleri uyar\u0131nca istifa etmek suretiyle i\u015fyerinden ayr\u0131lan i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamaz.<\/span><\/p><p class=\"s6\"><span class=\"s5\">Esasen <\/span><span class=\"s5\">kanunda<\/span><span class=\"s5\"> i\u015f\u00e7inin istifas\u0131 ad\u0131 alt\u0131nda bir d\u00fczenlenme yer almamaktad\u0131r. Bu bak\u0131mdan i\u015f\u00e7inin hakl\u0131 bir sebebe dayanmadan ve bildirim \u00f6neli tan\u0131maks\u0131z\u0131n i\u015f s\u00f6zle\u015fmesini feshi, istifa olarak de\u011ferlendirilmelidir. \u0130stifa iradesinin kar\u015f\u0131 tarafa ula\u015fmas\u0131yla birlikte i\u015f ili\u015fkisi sona erer. \u0130stifan\u0131n i\u015fverence kabul\u00fc zorunlu de\u011filse de, i\u015fverence dilek\u00e7enin i\u015fleme konulmam\u0131\u015f olmas\u0131 ve i\u015f\u00e7inin de i\u015fyerinde \u00e7al\u0131\u015fmaya devam etmesi halinde ger\u00e7ek bir istifadan s\u00f6z edilemez.<\/span><\/p><p class=\"s6\"><span class=\"s5\">\u015earta ba\u011fl\u0131 istifa ise kural olarak ge\u00e7erli de\u011fildir. Uygulamada en \u00e7ok kar\u015f\u0131la\u015f\u0131lan \u015fekliyle, i\u015f\u00e7inin ihbar ve k\u0131dem tazminat\u0131 haklar\u0131n\u0131n \u00f6denmesi \u015fart\u0131yla ayr\u0131lma talebi istifa olarak de\u011fil, ikale (bozma s\u00f6zle\u015fmesi) yapma y\u00f6n\u00fcnde bir icap olarak de\u011ferlendirilmelidir.<\/span><\/p><p style=\"padding-left: 40px;\"><strong><span class=\"s7\">A. <\/span><span class=\"s8\">\u0130\u015e\u00c7\u0130N\u0130N HAKLI NEDENLE DERHAL FES\u0130H HAKKI<\/span><\/strong><\/p><p style=\"padding-left: 40px;\"><span class=\"s5\">Belirli veya belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmeleri \u0130\u015f Kanunu m. 24\u2019te say\u0131lan hakl\u0131 nedenle fesih hallerinden biri ger\u00e7ekle\u015fti\u011finde herhangi bir fesih bildirim s\u00fcresi beklenmeksizin derhal i\u015f ili\u015fkisini sona erdirebilir. \u0130\u015f akdinin hakl\u0131 nedenle feshedildi\u011finin ispat y\u00fck\u00fc i\u015f\u00e7iye aittir. <\/span><\/p><p style=\"padding-left: 40px;\"><strong><span class=\"s8\">I. Sa\u011fl\u0131k sebepleri:<\/span><\/strong><\/p><p style=\"padding-left: 80px;\"><span class=\"s8\"><strong>a)<\/strong> <\/span><span class=\"s5\">\u0130\u015f s\u00f6zle\u015fmesinin konusu olan i\u015fin yap\u0131lmas\u0131 i\u015fin niteli\u011finden do\u011fan bir sebeple i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131 veya ya\u015fay\u0131\u015f\u0131 i\u00e7in tehlikeli olursa.<\/span><\/p><p style=\"padding-left: 80px;\"><span class=\"s8\"><strong>b)<\/strong> <\/span><span class=\"s5\">\u0130\u015f\u00e7inin s\u00fcrekli olarak yak\u0131ndan ve do\u011frudan bulu\u015fup g\u00f6r\u00fc\u015ft\u00fc\u011f\u00fc i\u015fveren yahut ba\u015fka bir i\u015f\u00e7i bula\u015f\u0131c\u0131 veya i\u015f\u00e7inin i\u015fi ile ba\u011fda\u015fmayan bir hastal\u0131\u011fa tutulursa.<\/span><\/p><p class=\"s6\" style=\"padding-left: 40px;\"><strong><span class=\"s8\">II. Ahlak ve iyi<\/span><span class=\"s8\"> <\/span><span class=\"s8\">niyet kurallar\u0131na uymayan haller ve benzerleri:<\/span><\/strong><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">a) <\/span><\/strong><span class=\"s5\">\u0130\u015fveren i\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri hakk\u0131nda yanl\u0131\u015f vas\u0131flar veya \u015fartlar g\u00f6stermek yahut ger\u00e7e\u011fe uygun olmayan bilgiler vermek veya s\u00f6zler s\u00f6ylemek suretiyle i\u015f\u00e7iyi yan\u0131lt\u0131rsa.<\/span><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">b) <\/span><\/strong><span class=\"s5\">\u0130\u015fveren i\u015f\u00e7inin veya ailesi \u00fcyelerinden birinin \u015feref ve namusuna dokunacak \u015fekilde s\u00f6zler s\u00f6yler, davran\u0131\u015flarda bulunursa veya i\u015f\u00e7iye cinsel tacizde bulunursa.<\/span><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">c)<\/span><\/strong><span class=\"s5\"> \u0130\u015fveren i\u015f\u00e7iye veya ailesi \u00fcyelerinden birine kar\u015f\u0131 sata\u015fmada bulunur veya g\u00f6zda\u011f\u0131 verirse, yahut i\u015f\u00e7iyi veya ailesi \u00fcyelerinden birini kanuna kar\u015f\u0131 davran\u0131\u015fa \u00f6zendirir, k\u0131\u015fk\u0131rt\u0131r, s\u00fcr\u00fckler, yahut i\u015f\u00e7iye ve ailesi \u00fcyelerinden birine kar\u015f\u0131 hapsi gerektiren bir su\u00e7 i\u015flerse yahut i\u015f\u00e7i hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z a\u011f\u0131r isnad veya ithamlarda bulunursa.<\/span><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">d) <\/span><\/strong><span class=\"s5\">\u0130\u015f\u00e7inin di\u011fer bir i\u015f\u00e7i veya \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan i\u015fyerinde cinsel tacize u\u011framas\u0131 ve bu durumu i\u015fverene bildirmesine ra\u011fmen gerekli \u00f6nlemler al\u0131nmazsa.<\/span><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">e)<\/span><\/strong><span class=\"s5\"> \u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin \u00fccreti kanun h\u00fck\u00fcmleri veya s\u00f6zle\u015fme \u015fartlar\u0131na uygun olarak hesap edilmez veya \u00f6denmezse,<\/span><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><strong><span class=\"s8\">f) <\/span><\/strong><span class=\"s5\">\u00dccretin par\u00e7a ba\u015f\u0131na veya i\u015f tutar\u0131 \u00fczerinden \u00f6denmesi kararla\u015ft\u0131r\u0131l\u0131p da i\u015fveren taraf\u0131ndan i\u015f\u00e7iye yapabilece\u011fi say\u0131 ve tutardan az i\u015f verildi\u011fi hallerde, aradaki \u00fccret fark\u0131 zaman esas\u0131na g\u00f6re \u00f6denerek i\u015f\u00e7inin eksik ald\u0131\u011f\u0131 \u00fccret kar\u015f\u0131lanmazsa, yahut \u00e7al\u0131\u015fma \u015fartlar\u0131 uygulanmazsa.<\/span><\/p><p class=\"s12\" style=\"padding-left: 40px;\"><strong><span class=\"s8\">III. Zorlay\u0131c\u0131 sebepler:<\/span><\/strong><\/p><p class=\"s11\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131karsa.<\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-751e704 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"751e704\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"s9\" style=\"padding-left: 40px;\"><strong><span class=\"s7\">B. <\/span><span class=\"s8\">\u0130\u015e\u00c7\u0130N\u0130N \u0130ST\u0130FASI HAL\u0130NDE KIDEM TAZM\u0130NATI<\/span><\/strong><\/div><p class=\"s13\" style=\"padding-left: 40px;\"><span class=\"s5\">Kural olarak istifa eden i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamayacakt\u0131r. Ancak uygulamada Yarg\u0131tay Kararlar\u0131 do\u011frultusunda belirli durumlarda istifa eden \u00e7al\u0131\u015fanlara da tazmi<\/span><span class=\"s5\">nat alabilme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. <\/span><span class=\"s5\">\u0130stifa eden \u00e7al\u0131\u015fanlar\u0131n Yarg\u0131tay kararlar\u0131 do\u011frultusunda a\u015fa\u011f\u0131da belirtilen hallerde k\u0131dem tazminat\u0131 alabilmesi m\u00fcmk\u00fcnd\u00fcr: <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">I. <\/span><span class=\"s8\">Sa\u011fl\u0131k <\/span><\/strong><span class=\"s8\"><strong>Nedenlerine Dayal\u0131 Olarak Hakl\u0131 Nedenle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/strong> <\/span><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015f yerindeki zorlu \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n i\u015f\u00e7inin sa\u011fl\u0131\u011f\u0131n\u0131 olumsuz y\u00f6nde etkilemesi (\u00d6rne\u011fin i\u015f kazalar\u0131, meslek hastal\u0131\u011f\u0131) nedeniyle i\u015f\u00e7i, i\u015f akdini tek tarafl\u0131 olarak sonland\u0131rabilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir.<\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">II. <\/span><span class=\"s8\">Mobbing (Psikolojik \u015eiddet) Gerek\u00e7esiyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131,<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">Mobbing nedeniyle i\u015f\u00e7inin i\u015ften ayr\u0131lmas\u0131 durumunda, ispat y\u00fck\u00fc i\u015f\u00e7ide olmakla birlikte i\u015f\u00e7inin mobbingi belgelemesi ko\u015fuluyla i\u015f\u00e7i, i\u015f akdini tek tarafl\u0131 olarak sonland\u0131rabilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir. Ancak bu tarz davran\u0131\u015flar\u0131n mobbing olarak de\u011ferlendirilebilmesi i\u00e7in i\u015fveren taraf\u0131ndan kas\u0131tl\u0131, s\u00fcrekli ve i\u015f\u00e7iye y\u00f6nelik olarak ger\u00e7ekle\u015ftirmesi gerekmektedir. <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">III. <\/span><span class=\"s8\">\u00dccretinin <\/span><span class=\"s8\">\u00d6denmemesi Yahut Zaman\u0131nda \u00d6denmemesi Nedeniyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015fveren taraf\u0131ndan i\u015f\u00e7inin \u00fccreti kanun h\u00fck\u00fcmleri yahut s\u00f6zle\u015fme \u015fartlar\u0131na uygun olarak \u00f6denmez veya eksik \u00f6denirse i\u015f\u00e7i, i\u015f akdini tek tarafl\u0131 olarak sonland\u0131rabilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir. \u0130\u015f\u00e7i, \u00fccreti d\u0131\u015f\u0131nda di\u011fer i\u015f\u00e7ilik alacaklar\u0131n\u0131n eksik \u00f6denmesi halinde yine i\u015f akdini tek tarafl\u0131 olarak feshedebilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir. <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">IV. <\/span><span class=\"s8\">Y\u0131ll\u0131k <\/span><span class=\"s8\">\u0130zinlerin Kulland\u0131r\u0131lmamas\u0131 Nedeniyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015f\u00e7inin, kanun h\u00fck\u00fcmleri gere\u011fi y\u0131ll\u0131k izinlerinin kulland\u0131r\u0131lmamas\u0131 durumunda i\u015f\u00e7i istifa ederek k\u0131dem tazminat\u0131na hak kazanabilecektir.<\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">V. <\/span><span class=\"s8\">Fazla Mesai \u00dccretinin \u00d6denmemesi Nedeniyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015f\u00e7i, resmi tatil g\u00fcnleri ve dini bayramlarda \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 halde \u00fccreti \u00f6denmedi\u011fi takdirde istifa ederek k\u0131dem tazminat\u0131na hak kazanabilecektir. Bunun yan\u0131 s\u0131ra kanun kapsam\u0131nda en y\u00fcksek mesai s\u0131n\u0131r\u0131 olan y\u0131ll\u0131k 270 saati a\u015facak \u015fekilde fazla mesai yapmaya zorlan\u0131yorsa yine istifa ederek k\u0131dem tazminat\u0131na hak kazanabilecektir. <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">VI. <\/span><span class=\"s8\">\u00c7al\u0131\u015fma <\/span><span class=\"s8\">Ko\u015fullar\u0131nda Esasl\u0131 De\u011fi\u015fiklik Yap\u0131lmas\u0131 Nedeniyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s16\">\u00a0\u0130\u015fveren, i\u015f s\u00f6zle\u015fmesiyle veya i\u015f s\u00f6zle\u015fmesinin eki niteli\u011findeki personel y\u00f6netmeli\u011fi ve benzeri kaynaklar ya da i\u015fyeri uygulamas\u0131yla olu\u015fan \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fiklik yap\u0131lmas\u0131 halinde i\u015f\u00e7i hakl\u0131 nedenle istifa edebilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir. <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">VII. <\/span><span class=\"s8\">SGK <\/span><span class=\"s8\">Primlerinin D\u00fc\u015f\u00fck Yat\u0131r\u0131lmas\u0131 Nedeniyle \u0130stifa Durumunda K\u0131dem Tazminat\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s5\">\u0130\u015fveren taraf\u0131ndan daha d\u00fc\u015f\u00fck SGK primi \u00f6demek i\u00e7in i\u015f\u00e7inin maa\u015f\u0131n\u0131n daha az g\u00f6sterilmesi durumunda i\u015f\u00e7i hakl\u0131 nedenle istifa edebilecek ve k\u0131dem tazminat\u0131na hak kazanabilecektir. Bununla birlikte i\u015f\u00e7inin haberi olmaks\u0131z\u0131n i\u015fveren taraf\u0131ndan <\/span><span class=\"s5\">SGK kay\u0131tlar\u0131nda i\u015fe giri\u015f \u00e7\u0131k\u0131\u015f i\u015flemleri yap\u0131l\u0131rsa bu durumda yine i\u015f\u00e7i hakl\u0131 nedenle istifa ederek k\u0131dem tazminat\u0131na hak kazanabilecektir. <\/span><\/p><div class=\"s14\" style=\"padding-left: 80px;\"><strong><span class=\"s7\">VIII. <\/span><span class=\"s8\">Bask\u0131yla <\/span><span class=\"s8\">Al\u0131nan v<\/span><span class=\"s8\">eya \u015earta Ba\u011flanan \u0130stifa Dilek\u00e7esinin Varl\u0131\u011f\u0131<\/span><\/strong><\/div><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s8\">\u0130\u015fe ilk giri\u015fte i\u015f\u00e7iden bo\u015f ka\u011f\u0131da att\u0131r\u0131lan imzan\u0131n daha sonra i\u015fverence istifa dilek\u00e7esiymi\u015f gibi doldurulmas\u0131 <\/span><span class=\"s5\">durumunda ortaya \u00e7\u0131kar\u0131lan istifa dilek\u00e7esi ge\u00e7ersiz say\u0131l\u0131r. Ancak i\u015f\u00e7inin bu hususu tan\u0131k dahil her t\u00fcrl\u00fc delille ispatlamas\u0131 gerekmektedir. <\/span><\/p><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s8\">\u0130stifa dilek\u00e7esinin al\u0131nd\u0131ktan sonraki bir tarihte i\u015fleme konulmas\u0131 durumunda <\/span><span class=\"s5\">i\u015fveren taraf\u0131ndan kabul edilmeyen istifa dilek\u00e7esi ileri tarihte istifa dilek\u00e7esi olarak kullan\u0131lamaz. Yarg\u0131tay da bir\u00e7ok g\u00f6r\u00fc\u015f\u00fcnde bu hususu vurgulam\u0131\u015ft\u0131r. <\/span><\/p><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s8\">\u0130stifa dilek\u00e7esi ile \u00e7eli\u015fen delil ve beyanlar\u0131n bulunmas\u0131 halinde <\/span><span class=\"s5\">istifa dilek\u00e7esi ge\u00e7erli say\u0131lmayacakt\u0131r.<\/span><\/p><p class=\"s15\" style=\"padding-left: 80px;\"><span class=\"s8\">\u0130\u015f\u00e7inin dayand\u0131\u011f\u0131 ger\u00e7ek sebep ile istifa dilek\u00e7esi kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda istifa dilek\u00e7esinde yaln\u0131zca \u201cistifa ettim\u201d demek suretiyle ger\u00e7ek istifa nedeni hakk\u0131nda bilgi vermedi\u011fi durumlarda <\/span><span class=\"s5\">yarg\u0131lama esnas\u0131nda istifan\u0131n ger\u00e7ek nedeninin ara\u015ft\u0131r\u0131lmas\u0131 gerekmektedir. <\/span><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a31f13f exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"a31f13f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"s9\" style=\"padding-left: 40px;\"><div class=\"s9\"><strong><span class=\"s7\">C. <\/span><\/strong><span class=\"s8\"><strong>\u0130\u015e\u00c7\u0130N\u0130N SEBEP BEL\u0130RTMEDEN \u0130ST\u0130FA D\u0130LEK\u00c7ES\u0130 SUNMASI VE MAKUL S\u00dcREDE A\u00c7ACA\u011eI DAVA \u0130LE HAKLI SEBEPLER\u0130N \u0130LER\u0130 S\u00dcR\u00dcLMES\u0130<\/strong> <\/span><\/div><p class=\"s13\"><span class=\"s5\">\u0130\u015f\u00e7i,<\/span><span class=\"s5\"> istifa dilek\u00e7esinde sebep belirtmese dahi i\u015f\u00e7inin makul s\u00fcre i\u00e7erisinde a\u00e7aca\u011f\u0131 dava ile de hakl\u0131 fesih sebeplerini belirterek tazminat isteyebilme hakk\u0131 vard\u0131r. \u00d6rne\u011fin Yarg\u0131tay taraf\u0131ndan 1 y\u0131l makul s\u00fcre kabul edilmi\u015ftir. <\/span><\/p><p class=\"s13\"><span class=\"s5\">Ancak i\u015f\u00e7inin istifa dilek\u00e7esinde sebep belirtmesi halinde bu sebeple ba\u011fl\u0131 oldu\u011fu gibi \u201c\u00f6zel nedenlerle, ailevi nedenlerle istifa ediyorum\u201d \u015feklinde istifa metninde irade belirtmesi de genel ge\u00e7er kavram olarak Yarg\u0131tay kararlar\u0131nda kabul edilmemi\u015ftir.<\/span><span class=\"s17\"> (Yarg\u0131tay 9. Hukuk Dairesi 2016\/28668 E. 2020\/12932 K. Say\u0131l\u0131 Karar\u0131) <\/span><\/p><p class=\"s19\"><span class=\"s18\">Yarg\u0131tay 22. Hukuk Dairesi <\/span><span class=\"s18\">E. 2015\/30425 K. 2018\/7733 T. 26.3.2018<\/span><\/p><p class=\"s13\"><span class=\"s18\">\u201c<\/span><span class=\"s18\">\u0130\u015f\u00e7inin istifa dilek\u00e7esindeki iradesinin fesada u\u011frat\u0131lmas\u0131 da s\u0131k\u00e7a kar\u015f\u0131la\u015f\u0131lan bir durumdur. \u0130\u015fverenin tazminatlar\u0131n derhal \u00f6denece\u011fi s\u00f6z\u00fcn\u00fc vermek ve benzeri bask\u0131larla i\u015f\u00e7iden yaz\u0131l\u0131 istifa dilek\u00e7esi vermesini talep etmesi ve i\u015f\u00e7inin buna uymas\u0131 halinde, ger\u00e7ek bir istifa iradesinden s\u00f6z edilemez. Bu halde, istifa iradesinin bulunmad\u0131\u011f\u0131na y\u00f6nelik olarak irade fesad\u0131 iddias\u0131 tan\u0131k dahil her t\u00fcrl\u00fc delil ile ispatlanabilir.<\/span><\/p><p class=\"s13\"><span class=\"s18\">Somut olayda, davac\u0131 asil taraf\u0131ndan ibraz edilmi\u015f 02.06.2014 tarihli dava dilek\u00e7esinde, i\u015f akdinin i\u015fveren taraf\u0131ndan 1475 Say\u0131l\u0131 yasaya ayk\u0131r\u0131 \u015fekilde son verild\u011fi belirtilerek k\u0131dem tazminat\u0131 dahil talep konusu di\u011fer i\u015f\u00e7ilik alacaklar\u0131n\u0131n daval\u0131dan tahsiline karar verilmesi talep edilmi\u015ftir. Daval\u0131 vekili ise dosya kapsam\u0131nda yer alan 15.01.2014 tarihli istifa dilek\u00e7esine dayanarak i\u015f s\u00f6zle\u015fmesinin k\u0131dem tazminat\u0131na hak kazand\u0131rmayacak \u015fekilde sona erdi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Mahkemece, <\/span><span class=\"s18\">davac\u0131n\u0131n 1954 do\u011fumlu olup ya\u015f itibariyle 24 saat bek\u00e7ilik g\u00f6revini yapmakta zorlanabilece\u011fi, davac\u0131n\u0131n \u00f6denmemi\u015f ulusal bayram ve genel tatil \u00fccreti alacaklar\u0131 olmas\u0131 sebebi ile i\u015f akdini feshetmekte hakl\u0131 nedeni bulundu\u011fu, \u00fc\u00e7 y\u0131la yak\u0131n \u00e7al\u0131\u015fmas\u0131 olan i\u015f\u00e7inin k\u0131dem tazminat\u0131n\u0131 yakarak istifa etmesinin hayat\u0131n ola\u011fan ak\u0131\u015f\u0131na ayk\u0131r\u0131 olaca\u011f\u0131 gerek\u00e7esiyle i\u015f s\u00f6zle\u015fmesinin k\u0131dem tazminat\u0131na hak kazan\u0131lacak \u015fekilde sona erdi\u011fi kabul edilerek davac\u0131n\u0131n k\u0131dem tazminat\u0131 talebi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/span><\/p><p class=\"s13\"><span class=\"s18\">Davac\u0131 her ne kadar dava dilek\u00e7esinde i\u015f akdinin i\u015fverence haks\u0131z \u015fekilde sona erdirildi\u011fi iddias\u0131nda bulunmu\u015f ise de, davac\u0131 taraf\u0131ndan el yaz\u0131s\u0131 ile yaz\u0131lm\u0131\u015f ve imzalanm\u0131\u015f 15.01.2014 tarihli istifa dilek\u00e7esi kapsamda olup, ilgili dilek\u00e7ede davac\u0131n\u0131n sa\u011fl\u0131k sorunlar\u0131 sebebi ile kendi iste\u011fiyle i\u015fyerinden ayr\u0131ld\u0131\u011f\u0131 yaz\u0131l\u0131d\u0131r, Davac\u0131 asil 17\/11\/2014 tarihli celsedeki beyan\u0131nda, sa\u011fl\u0131k sorunlar\u0131 oldu\u011funu ikrar etmi\u015ftir. Ancak davac\u0131 asil ayn\u0131 tarihli celsedeki ifadesinde istifa dilek\u00e7esinin daval\u0131 nezdinde bulunan bo\u015f senet tehdidi ile yazd\u0131r\u0131l\u0131p imzaland\u0131\u011f\u0131n\u0131 da beyan etmi\u015f ise de, bo\u015f senedin kendisine alt\u0131 ay sonra verildi\u011fini belirtmi\u015f olup iradenin sakatland\u0131\u011f\u0131n\u0131 ve tehdit alt\u0131nda istifa dilek\u00e7esinin imzaland\u0131\u011f\u0131n\u0131 ispat edememi\u015ftir. Ayr\u0131ca davac\u0131n\u0131n dava dilek\u00e7esindeki beyan\u0131 ile yarg\u0131lama a\u015famas\u0131ndaki beyan\u0131 birbiriyle \u00e7eli\u015fir mahiyettedir.<\/span><\/p><p class=\"s13\"><span class=\"s18\">Dosya kapsam\u0131na g\u00f6re davac\u0131n\u0131n sa\u011fl\u0131k sorunlar\u0131 sebebiyle istifa etmek suretiyle i\u015fyerinden ayr\u0131ld\u0131\u011f\u0131 sabit oldu\u011fundan, mahkemece gerek davac\u0131n\u0131n ya\u015f\u0131 gerekse de ulusal bayram ve genel tatil \u00fccreti alacaklar\u0131n\u0131n \u00f6denmemesi sebebiyle i\u015f s\u00f6zle\u015fmesinin feshinin hakl\u0131 nedene dayand\u0131\u011f\u0131 de\u011ferlendirmesinde bulunulmas\u0131 davac\u0131 talebiyle \u00e7eli\u015fir ve talebi a\u015far mahiyettedir. Bu sebeple istifaya de\u011fer verilerek k\u0131dem tazminat\u0131n\u0131n reddi gerekirken yaz\u0131l\u0131 \u015fekilde kabul\u00fc hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.\u201d<\/span><\/p><p class=\"s13\"><span class=\"s18\">Yarg\u0131tay 9. Hukuk Dairesi 2016\/21607 E. 2020\/8967 K. Say\u0131l\u0131 \u0130lam\u0131;<\/span><\/p><p class=\"s13\"><span class=\"s18\">Dosya i\u00e7erisinde davac\u0131n\u0131n 18.08.2014 tarihli imzal\u0131 istifa dilek\u00e7esinde; &#8220;01.09.2005 tarihinden beri \u00e7al\u0131\u015fmakta oldu\u011fum fabrikan\u0131zdan ailevi sebeplerden dolay\u0131 i\u015f akdimin feshini sayg\u0131lar\u0131mla arz ederim.&#8221; yaz\u0131l\u0131d\u0131r. Davac\u0131 taraf\u00e7a ilgili istifa dilek\u00e7esinin bask\u0131 alt\u0131nda al\u0131nd\u0131\u011f\u0131na y\u00f6nelik herhangi delil de sunulmam\u0131\u015ft\u0131r. Davac\u0131n\u0131n 19.08.2014 tarihli i\u015ften ayr\u0131lma bildirgesi; belirsiz s\u00fcreli s\u00f6zle\u015fmenin i\u015f\u00e7i taraf\u0131ndan sona erdirilmesi, istifa olarak 03 kod ile d\u00fczenlenmi\u015ftir. Ayr\u0131ca davac\u0131n\u0131n hizmet d\u00f6k\u00fcm cetveline g\u00f6re daval\u0131 i\u015fyerinden ayr\u0131ld\u0131ktan 2 g\u00fcn sonra ba\u015fka yerde i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Yarg\u0131lama s\u0131ras\u0131nda dinlenen davac\u0131 tan\u0131klar\u0131 davac\u0131dan \u00f6nce i\u015ften ayr\u0131lm\u0131\u015f olmakla feshe dair g\u00f6rg\u00fcye dayal\u0131 bilgileri olmad\u0131\u011f\u0131n\u0131 ancak duyuma dayal\u0131 bilgileri oldu\u011funu belirterek davac\u0131n\u0131n i\u015f akdini kendisi feshetti\u011fini beyan etmi\u015flerdir. Davac\u0131 tan\u0131klar\u0131n\u0131n bu soyut beyanlar\u0131na itibar edilemez. Daval\u0131 tan\u0131klar\u0131 da davac\u0131n\u0131n i\u015f akdini istifa ederek kendi feshetti\u011fini beyan etmi\u015flerdir.<\/span><\/p><p class=\"s13\"><span class=\"s18\">Hal b\u00f6yle iken, istifa belgesine itibar edilerek i\u015f s\u00f6zle\u015fmesinin davac\u0131 taraf\u0131ndan hakl\u0131 bir neden olmadan feshedildi\u011fi anla\u015f\u0131lmakla, k\u0131dem tazminat\u0131 talebinin reddi gerekirken, kabul\u00fcne karar verilmesi hatal\u0131d\u0131r ve bozmay\u0131 gerektirmi\u015ftir.<\/span><span class=\"s18\">\u201d<\/span><\/p><\/div>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b9a66e exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"8b9a66e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\"s6\"><span class=\"s5\">Sonu\u00e7 olarak; <\/span><span class=\"s5\">\u0130\u015f\u00e7i,<\/span><span class=\"s5\"> <\/span><span class=\"s5\">\u0130\u015f Kanunu m. 24\u2019te say\u0131lan hakl\u0131 nedenle fesih hallerinden biri ger\u00e7ekle\u015fti\u011finde herhangi bir fesih bildirim s\u00fcresi beklenmeksizin derhal<\/span><span class=\"s5\"> i\u015f ili\u015fkisini sona erdirebilmekte ve k\u0131dem tazminat\u0131na hak kazanabilmektedir. Bununla birlikte \u0130\u015f K<\/span><span class=\"s5\">anun<\/span><span class=\"s5\">un<\/span><span class=\"s5\">da<\/span><span class=\"s5\"> i\u015f\u00e7inin istifas\u0131 ad\u0131 alt\u0131nda bir d\u00fcze<\/span><span class=\"s5\">nlenme yer almamakla birlikte<\/span><span class=\"s5\"> i\u015f\u00e7inin hakl\u0131 bir sebebe dayanmadan ve bildirim \u00f6neli tan\u0131maks\u0131z\u0131n i\u015f s\u00f6zle\u015fmesini feshi, istifa olarak <\/span><span class=\"s5\">de\u011ferlendirilme<\/span><span class=\"s5\">ktedir. <\/span><span class=\"s5\">Kural olarak istifa eden i\u015f\u00e7i k\u0131dem tazminat\u0131na hak kazanamayacakt\u0131r. Ancak Yarg\u0131tay Kararlar\u0131 do\u011frultusunda belirli durumlarda istifa eden \u00e7al\u0131\u015fanlara da tazminat alabilme hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r.
