Kiraya verenin, kirac\u0131y\u0131 kiralanandan tahliye etmesinin \u00f6n\u00fcn\u00fc a\u00e7an ve bu kirac\u0131 lehine d\u00fczenlemelerin kar\u015f\u0131s\u0131nda yer alan yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc kurumu ise uygulamada \u00f6nemli yer kaplamakta ve yarg\u0131 kararlar\u0131na konu olmaktad\u0131r.<\/p>\n<p>Tahliye taahh\u00fcd\u00fcn\u00fcn ko\u015fullar\u0131 as\u0131l olarak T\u00fcrk Bor\u00e7lar Kanununda yer almakla birlikte, Yarg\u0131tay i\u00e7tihatlar\u0131nda da bu taahh\u00fctte bulunmas\u0131 gereken \u00e7e\u015fitli \u015fartlara h\u00fckmedilmi\u015ftir.<\/p>\n<p>Meseleyi farkl\u0131 ba\u015fl\u0131klar alt\u0131nda incelemek gerekir.<\/p>\n<ul>\n<li><strong> <\/strong><strong><u>6098 S. T\u00dcRK BOR\u00c7LAR KANUNU BAKIMINDAN<\/u><\/strong><\/li>\n<\/ul>\n<p>Kanunun konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmenin sona ermesi ba\u015fl\u0131\u011f\u0131nda kirac\u0131dan kaynaklanan sebeplerle s\u00f6zle\u015fmenin sona ermesini d\u00fczenleyen <strong>352. maddesine g\u00f6re;<\/strong><\/p>\n<p><strong><em>\u201c<\/em><\/strong><em>Kirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, <u>kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde<\/u> bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak <u>bir ay i\u00e7inde<\/u> icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir.\u201d<\/em><\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere h\u00fck\u00fcmdeki ko\u015fullara uygun tahliye taahh\u00fcd\u00fc al\u0131nd\u0131\u011f\u0131 takdirde kiraya verenin s\u00fcresi i\u00e7inde icra dairesine ba\u015fvurmak veya dava a\u00e7mak yoluyla kirac\u0131n\u0131n tahliyesini sa\u011flamas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>TBK m.352 uyar\u0131nca gerekli ko\u015fullar ise \u015funlard\u0131r:<\/p>\n<ul>\n<li><strong> <\/strong><strong>Kirac\u0131n\u0131n vermi\u015f oldu\u011fu tahliye taahh\u00fcd\u00fc yaz\u0131l\u0131 olmal\u0131d\u0131r.<\/strong><\/li>\n<\/ul>\n<p>Ad\u0131ndan da anla\u015f\u0131laca\u011f\u0131 \u00fczere tahliye taahh\u00fcd\u00fc yaz\u0131l\u0131 olmal\u0131d\u0131r. Bu bir ge\u00e7erlilik ko\u015fuludur. S\u00f6zl\u00fc verilen taahh\u00fctler herhangi bir sonu\u00e7 do\u011furmaz. Adi yaz\u0131l\u0131 \u015fekil yeterlidir. Ancak noterde resmi yaz\u0131l\u0131 \u015fekilde haz\u0131rlanmas\u0131 kiraya verenin lehinedir.<\/p>\n<ul>\n<li><strong> <\/strong><strong>Taahh\u00fctname, kirac\u0131 veya onun yetkili temsilcisi taraf\u0131ndan verilmelidir.<\/strong><\/li>\n<\/ul>\n<p>Ayn\u0131 konutu veya \u00e7at\u0131l\u0131 i\u015fyerini kullanan kirac\u0131 d\u0131\u015f\u0131ndaki ki\u015filer bu taahh\u00fct\u00fc veremeyeceklerdir. Yaln\u0131zca s\u00f6zle\u015fmenin taraf\u0131 olan kirac\u0131 taahh\u00fctte bulunabilir. Yine kirac\u0131n\u0131n \u00f6zel yetkili vekaletname verdi\u011fi vekili de taahh\u00fcte imza atabilir.<\/p>\n<p>Birden fazla kirac\u0131 varsa her birinin imzas\u0131 gerekmektedir. Yarg\u0131tay\u2019\u0131n i\u00e7tihatlar\u0131nda bu hususa rastlanmaktad\u0131r.<\/p>\n<p><strong>&nbsp;<\/strong><\/p>\n<p><\/p>\n<p>Kirac\u0131 t\u00fczel ki\u015fi ise, t\u00fczel ki\u015fiyi temsile yetkili ki\u015filerce bu taahh\u00fcd\u00fcn verilmesi gerekir.<\/p>\n<p>Usul hukuku a\u00e7\u0131s\u0131ndan da tahliye davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131nda tahliye talebi b\u00f6l\u00fcnebilir bir talep olmad\u0131\u011f\u0131ndan b\u00fct\u00fcn kirac\u0131lara husumet y\u00f6neltilmelidir (zorunlu dava arkada\u015fl\u0131\u011f\u0131).<\/p>\n<ul>\n<li><strong> <\/strong><strong>Tahliye taahh\u00fcd\u00fc, kira s\u00f6zle\u015fmesinin kurulmas\u0131ndan ve ta\u015f\u0131nmaz\u0131n tesliminden sonra verilmelidir.<\/strong><\/li>\n<\/ul>\n<p>Kira s\u00f6zle\u015fmesinin imzaland\u0131\u011f\u0131 s\u0131rada kirac\u0131n\u0131n bask\u0131 alt\u0131nda olaca\u011f\u0131 ve iradesinin sa\u011fl\u0131kl\u0131 olmayaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclerek bu y\u00f6nde bir d\u00fczenlemeye gidilmi\u015ftir. S\u00f6zle\u015fme imzaland\u0131ktan ve ta\u015f\u0131nmaz kirac\u0131ya teslim edildikten sonra herhangi bir tarihte taahh\u00fct verilebilir. Kirac\u0131 diledi\u011fi tarih i\u00e7in taahh\u00fct verebilir.<\/p>\n<ul>\n<li><strong> <\/strong><strong>Taahh\u00fctname hi\u00e7bir kay\u0131t ve \u015farta ba\u011flanamaz. <\/strong><\/li>\n<\/ul>\n<p>Kirac\u0131, taahh\u00fcd\u00fcnde kiraya verene kar\u015f\u0131 bir ko\u015ful ileri s\u00fcremez. \u00d6rne\u011fin, \u201cYeni bir konut buldu\u011fum takdirde\u201d gibi bir kay\u0131t yer al\u0131rsa taahh\u00fctname ge\u00e7ersiz olacakt\u0131r.<\/p>\n<ul>\n<li><strong> <\/strong><strong>Tahliye taahh\u00fcd\u00fcndeki tarih belirli olmal\u0131d\u0131r.<\/strong><\/li>\n<\/ul>\n<p>Kirac\u0131, a\u00e7\u0131k\u00e7a belirlenebilen bir tarih se\u00e7melidir. Mu\u011flak tarihler i\u00e7eren ifadeler taahh\u00fcd\u00fc ge\u00e7ersiz k\u0131lacakt\u0131r. Tarihin g\u00fcn, ay ve y\u0131l olarak net \u015fekilde belirlenebilir olmas\u0131 gerekmektedir.<\/p>\n<p><\/p>\n<p>Yukar\u0131daki ko\u015fullar\u0131 i\u00e7eren bir tahliye taahh\u00fctnamesini alan kiraya veren, kirac\u0131n\u0131n taahh\u00fctnamede kiralanan\u0131 bo\u015faltmay\u0131 taahh\u00fct etti\u011fi tarihten itibaren <strong>bir ay i\u00e7inde<\/strong> icraya ba\u015fvurabilir veya dava a\u00e7abilir.<\/p>\n<p>S\u00f6z konusu s\u00fcre <strong>hak d\u00fc\u015f\u00fcr\u00fcc\u00fc<\/strong> olup, vaktinde kullan\u0131lmazsa kiraya verenin tahliye isteme hakk\u0131 kalmaz.<\/p>\n<p>Dava yolu tercih edildi\u011finde <strong>g\u00f6revli mahkeme<\/strong> HMK m.4 uyar\u0131nca sulh hukuk mahkemesidir. <strong>Yetkili mahkeme<\/strong> ise, tahliye talebi s\u00f6zle\u015fme ili\u015fkisinden do\u011fan bir talep oldu\u011fundan HMK m.6, m.7 ve m.10 uyar\u0131nca belirlenecek yetkili mahkemelerde a\u00e7\u0131labilecektir. Uygulamada genellikle daval\u0131n\u0131n yerle\u015fim yeri, s\u00f6zle\u015fmenin ifa olunaca\u011f\u0131 yer ve ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemeleri ayn\u0131 yerde oldu\u011fundan dava buradaki mahkemelerde a\u00e7\u0131lmaktad\u0131r.<\/p>\n<p><strong>TBK m.353\u2019e g\u00f6re <\/strong><em>\u201cKiraya veren, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r.\u201d <\/em><\/p>\n<p>Bu h\u00fck\u00fcm, tahliye taahh\u00fcd\u00fcne dayal\u0131 tahliye taleplerinde de ge\u00e7erlidir. Kiraya veren, kirac\u0131ya h\u00fck\u00fcmdeki bildirimi yapt\u0131\u011f\u0131nda dava hakk\u0131 bir kira y\u0131l\u0131 kadar uzayacakt\u0131r. Bildirim zaman\u0131, dava a\u00e7ma hakk\u0131n\u0131n do\u011fdu\u011fu andan itibaren dava a\u00e7ma s\u00fcresinin sonuna kadard\u0131r. Dava a\u00e7ma hakk\u0131n\u0131n do\u011fma sebebine g\u00f6re bu s\u00fcre farkl\u0131l\u0131k g\u00f6sterir. Tahliye taahh\u00fcd\u00fc bulundu\u011fu durumlarda bu s\u00fcre, taahh\u00fctteki belirli tarihten itibaren bir ayd\u0131r. Yani bildirim bu bir ay i\u00e7inde yap\u0131lmal\u0131d\u0131r.<\/p>\n<p>Kirac\u0131 taraf\u0131ndan tahliye taahh\u00fcd\u00fcn\u00fcn verilmesi an\u0131nda yan\u0131lma, aldatma, korkutma durumlar\u0131ndan birinin varl\u0131\u011f\u0131 halinde irade sakatl\u0131\u011f\u0131 sebebine dayan\u0131larak bir y\u0131l i\u00e7inde taahh\u00fctnamenin <strong>iptal edilmesi<\/strong> istenebilir.<\/p>\n<ul>\n<li><strong> <\/strong><strong><u>2004 S. \u0130CRA VE \u0130FLAS KANUNU BAKIMINDAN<\/u><\/strong><\/li>\n<\/ul>\n<p>Kiraya veren, taahh\u00fctnamede belirtilen tarihten itibaren bir ay i\u00e7inde dava de\u011fil de icra dairesi arac\u0131l\u0131\u011f\u0131 ile <strong>ilams\u0131z tahliye takibi<\/strong> yolunu se\u00e7ebilir.<\/p>\n<p>Bu durumda \u0130\u0130K\u2019n\u0131n m.272 ila m.275 h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p>Kirac\u0131ya bir <strong>tahliye emri<\/strong> g\u00f6nderilir. Kirac\u0131n\u0131n 7 g\u00fcn i\u00e7erisinde itiraz etme hakk\u0131 vard\u0131r.<\/p>\n<p><strong>\u0130\u0130K m.275:<\/strong> <em>\u201cTahliye talebi noterlik\u00e7e res\u2019en tanzim veya tarih ve imzas\u0131 tasdik edilmi\u015f yahut ikrar olunmu\u015f bir mukaveleye m\u00fcstenit olup da kirac\u0131 kiran\u0131n yenilendi\u011fine veya uzat\u0131ld\u0131\u011f\u0131na dair ayn\u0131 kuvvet ve mahiyette bir vesika g\u00f6steremezse itiraz kald\u0131r\u0131l\u0131r.\u201d<\/em><\/p>\n<p>Kirac\u0131, tahliye emrine itiraz etti\u011fi durumda, adi yaz\u0131l\u0131 kira s\u00f6zle\u015fmesindeki veya adi yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fcndeki imzay\u0131 veya tarihi a\u00e7\u0131k\u00e7a inkar ederse, kiraya veren icra mahkemesinden itiraz\u0131n kald\u0131r\u0131lmas\u0131n\u0131 isteyemez. Kiraya veren bu halde yaln\u0131zca sulh hukuk mahkemesinde tahliye davas\u0131 a\u00e7abilir (itiraz\u0131n iptali ve tahliye talebiyle).<\/p>\n<p>Tahliye taahh\u00fcd\u00fcn\u00fcn tarihi ve imzas\u0131 noterlik\u00e7e onayl\u0131 ise, kirac\u0131 adi yaz\u0131l\u0131 s\u00f6zle\u015fmedeki tarihi inkar etse dahi icra mahkemesi taraf\u0131ndan itiraz\u0131 kald\u0131r\u0131lmal\u0131d\u0131r.<\/p>\n<p><\/p>\n<ul>\n<li><strong> <\/strong><strong><u>UYGULAMADAK\u0130 \u00d6ZEL DURUMLAR VE YARGITAY \u0130\u00c7T\u0130HATLARI<\/u><\/strong><\/li>\n<li><strong>TBK\u2019n\u0131n 346. maddesi<\/strong> konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131 s\u00f6zle\u015fmelerinde kirac\u0131 aleyhine d\u00fczenleme yasa\u011f\u0131n\u0131 kaleme almak birlikte madde h\u00fckm\u00fc \u015fu \u015fekildedir; <em>\u201cKirac\u0131ya, kira bedeli ve yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemez. \u00d6zellikle, kira bedelinin zaman\u0131nda \u00f6denmemesi h\u00e2linde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin anla\u015fmalar ge\u00e7ersizdir.\u201d<\/em><\/li>\n<\/ul>\n<p><strong>&nbsp;<\/strong><\/p>\n<p>Bu h\u00fckme ra\u011fmen taraflar, yaz\u0131l\u0131 tahliye taahh\u00fctnamesi ile cezai \u015fart kararla\u015ft\u0131rabilirler. Tahliye taahh\u00fctnamesinin ayr\u0131 bir s\u00f6zle\u015fme olmas\u0131 nedeniyle bu husus Yarg\u0131tay taraf\u0131ndan da ge\u00e7erli kabul edilmektedir. Ancak cezai \u015fart miktar\u0131n\u0131n fahi\u015f olup olmad\u0131\u011f\u0131n\u0131n hakim taraf\u0131ndan de\u011ferlendirmeye tabi tutulmas\u0131 gerekmektedir.<\/p>\n<p><\/p>\n<ul>\n<li>Uygulamada s\u0131k rastlanan bir durum da kiraya verenlerin kira s\u00f6zle\u015fmesi akdedildi\u011fi s\u0131rada kirac\u0131dan bo\u015f veya ileri tarihli tahliye taahh\u00fcd\u00fc almaya \u00e7al\u0131\u015fmas\u0131d\u0131r. Bu halde kanun h\u00fckm\u00fcndeki \u015farta ayk\u0131r\u0131l\u0131k bulundu\u011fundan kirac\u0131n\u0131n iradesi sakat kabul edilecek ve taahh\u00fctname ge\u00e7ersiz olacakt\u0131r.<\/li>\n<\/ul>\n<p>Ancak Yarg\u0131tay son d\u00f6nem kararlar\u0131nda, taahh\u00fctnamenin kira s\u00f6zle\u015fmesinin kuruldu\u011fu s\u0131rada bo\u015f olarak verildi\u011finin ve \u00fczerindeki tarihin sonradan dolduruldu\u011fu iddias\u0131n\u0131n kirac\u0131 taraf\u0131ndan yaz\u0131l\u0131 delil (senet) ile ispat etmesini aramaktad\u0131r. Bu gibi hallerde ispat y\u00fck\u00fc kirac\u0131dad\u0131r. Kirac\u0131 senet g\u00f6sterebilece\u011fi gibi, yeminle de iddias\u0131n\u0131 ispat edebilir.
