Maddesinde: \u201cTabi servetler ve kaynaklar Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndad\u0131r. Bunlar\u0131n aranmas\u0131 ve i\u015fletilmesi hakk\u0131 Devlete aittir. Devlet bu hakk\u0131n\u0131 belli bir s\u00fcre i\u00e7in, ger\u00e7ek ve t\u00fczelki\u015filere devredebilir.\u2019\u2019 denilmek suretiyle madenlerin h\u00fck\u00fcm ve tasarrufu devlete b\u0131rak\u0131lm\u0131\u015ft\u0131r. Yani bunlar \u00fczerindeki haklar toprak \u00fczerindeki egemenli\u011fin bir yans\u0131mas\u0131 olarak devletin tekelindedir ve devredilemez. Lakin hem maden \u00e7\u0131karman\u0131n maliyeti ve ihtiya\u00e7 duyulan nitelikli teknolojinin devlet ayg\u0131t\u0131nda bulunmamas\u0131 hem de liberal ekonomik sistemin getirdi\u011fi sonu\u00e7lar itibariyle m\u00fclkiyet hakk\u0131 devlette kalmas\u0131 kayd\u0131yla arama yahut \u00e7\u0131karma yetkisi ba\u015fka bir ger\u00e7ek ya da t\u00fczel ki\u015fiye devredilmektedir. Yine ticari hayat\u0131n ihtiyac\u0131 ve maden sahalar\u0131ndaki hem tehlikeli \u00e7al\u0131\u015fma ortam\u0131 hem de birden fazla ticari i\u015ftirakin bir araya gelerek bahse konu yer alt\u0131 kaynaklar\u0131nda \u00e7al\u0131\u015fma yapmas\u0131n\u0131n m\u00fcmk\u00fcn olmas\u0131 halinde devletten maden ruhsat\u0131n\u0131 alm\u0131\u015f ki\u015filerin \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye buradaki haklar\u0131n\u0131 devretmesinin ge\u00e7erli yasal hali ancak bir r\u00f6d\u00f6vans s\u00f6zle\u015fmesi ile m\u00fcmk\u00fcnd\u00fcr.<\/p><p>\u00a0<\/p><p style=\"padding-left: 40px;\"><strong>R\u00d6D\u00d6VANS S\u00d6ZLE\u015eMELER\u0130<\/strong><\/p><p><br \/>Madenlerin i\u015fletilebilmesi, sahip oldu\u011fu riskler ve meydana gelebilecek tehlikeler sebebiyle kanun taraf\u0131ndan idarece al\u0131nacak ruhsat belgesine ba\u011flanm\u0131\u015ft\u0131r. Bu ruhsatlarla tan\u0131nan haklar\u0131n kullan\u0131m\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye devredilmesi amac\u0131yla yap\u0131lan s\u00f6zle\u015fmelere \u2018R\u00f6d\u00f6vans S\u00f6zle\u015fmesi\u2019 denir.<\/p><p>R\u00f6d\u00f6vans S\u00f6zle\u015fmeleri maden ruhsat sahibi ki\u015filerin kararla\u015ft\u0131racaklar\u0131 s\u00fcre zarf\u0131nda bu ruhsat\u0131n sa\u011flad\u0131\u011f\u0131 ara\u015ft\u0131rma, \u00e7\u0131karma, i\u015fletme gibi yetkileri ba\u015fka bir ki\u015fiye tahsis etti\u011fi, bunun kar\u015f\u0131l\u0131\u011f\u0131nda ise maden oca\u011f\u0131n\u0131n i\u015fletilmesini \u00fcstlenen ruhsat sahibine, \u00fcretece\u011fi madene g\u00f6re s\u00f6zle\u015fmede belirlenecek bedeli \u00f6demeyi taahh\u00fct etti\u011fi s\u00f6zle\u015fmedir. Bu s\u00f6zle\u015fme gere\u011fince,\u00a0r\u00f6d\u00f6vans veren, maden oca\u011f\u0131n\u0131n i\u015fletilmesini \u00fcstlenen \u00f6zel veya t\u00fczel ki\u015fi, ruhsat sahibine, \u00fcretti\u011fi her bir ton maden i\u00e7in \u00f6nceden \u00f6demeyi taahh\u00fct etti\u011fi mebla\u011f kadar bir \u00fccret \u00f6der.\u00a0S\u00f6zle\u015fmenin taraflar\u0131 ruhsat sahibi ve r\u00f6d\u00f6vans verendir. R\u00f6d\u00f6vans S\u00f6zle\u015fmesi yap\u0131labilmesi sair mevzuat h\u00fck\u00fcmlerinde baz\u0131 kriterlere ba\u011flanm\u0131\u015f olmakla birlikte yetkili kurum Maden ve Petrol \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn (MAPEG) iznine tabi tutulmu\u015ftur.<\/p><ul><li><strong>Hukuki Niteli\u011fi<\/strong><br \/>R\u00f6d\u00f6vans S\u00f6zle\u015fmelerinin hukuki niteli\u011fi doktrinde tart\u0131\u015fmal\u0131d\u0131r. Bu g\u00f6r\u00fc\u015flerden ilki s\u00f6zle\u015fme konusunun bir kamu mal\u0131 olmas\u0131 sebebiyle bir idari s\u00f6zle\u015fme oldu\u011funu savunurken kar\u015f\u0131t g\u00f6r\u00fc\u015f bu s\u00f6zle\u015fmenin taraflar\u0131ndan birinin idare olmamas\u0131 sebebiyle bu \u00e7er\u00e7eveye sokulamayaca\u011f\u0131n\u0131 ileri s\u00fcrmektedir.<\/li><\/ul><p style=\"padding-left: 40px;\">Di\u011fer taraftan doktrinde baz\u0131 ki\u015filerce ise bu bir \u00fcr\u00fcn s\u00f6zle\u015fmesidir. \u00dcr\u00fcn kiras\u0131, Bor\u00e7lar Kanunu\u2019nun 357 ve devam\u0131 maddelerinde d\u00fczenlenmi\u015f bulunan bir kira s\u00f6zle\u015fmesi t\u00fcr\u00fcd\u00fcr. Bu s\u00f6zle\u015fmeye g\u00f6re, kiraya veren, kirac\u0131ya, \u00fcr\u00fcn veren bir \u015feyin veya hakk\u0131n kullan\u0131lmas\u0131n\u0131 ve \u00fcr\u00fcnlerin dev\u015firilmesini bedel kar\u015f\u0131l\u0131\u011f\u0131nda b\u0131rakmay\u0131 \u00fcstlenmektedir. Bu s\u00f6zle\u015fme ile kirac\u0131n\u0131n elde etti\u011fi hak ki\u015fisel bir hak olup, kirac\u0131 bu hakka dayanarak ayn\u00ee hak talep edemez. R\u00f6d\u00f6vans s\u00f6zle\u015fmesi \u00f6zel olarak Bor\u00e7lar Kanunu, Maden Kanunu yahut herhangi bir mevzuatta d\u00fczenlenmemi\u015ftir. Bu nedenle, Yarg\u0131tay, r\u00f6d\u00f6vans s\u00f6zle\u015fmesinin Bor\u00e7lar Kanunu\u2019nun 270. maddesinde d\u00fczenlenmi\u015f olan \u00fcr\u00fcn kiras\u0131n\u0131n \u00f6zelliklerine sahip oldu\u011funu belirterek r\u00f6d\u00f6vans s\u00f6zle\u015fmesine \u00fcr\u00fcn kiras\u0131na ili\u015fkin h\u00fck\u00fcmlerin uygulanmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde i\u00e7tihat geli\u015ftirmi\u015ftir. \u00dcr\u00fcn kiras\u0131, kiralayan\u0131n \u00fcr\u00fcn kirac\u0131s\u0131na bir bedel kar\u015f\u0131l\u0131\u011f\u0131nda \u00fcr\u00fcn getiren bir hakk\u0131n kullan\u0131m\u0131n\u0131 b\u0131rakt\u0131\u011f\u0131, \u00fcr\u00fcn elde etme imk\u00e2n\u0131 sa\u011flad\u0131\u011f\u0131 bir s\u00f6zle\u015fme oldu\u011funa g\u00f6re, r\u00f6d\u00f6vans s\u00f6zle\u015fmesini \u00fcr\u00fcn kiras\u0131na benzetmek m\u00fcmk\u00fcnd\u00fcr.<\/p><p style=\"padding-left: 40px;\">Do\u011fas\u0131 gere\u011fi b\u00fcnyesinde riskler bar\u0131nd\u0131ran madencilik faaliyetleri Bor\u00e7lar Hukuku bak\u0131m\u0131ndan tehlike sorumlulu\u011fu ta\u015f\u0131maktad\u0131r. Bir kusursuz sorumluluk t\u00fcr\u00fc olan tehlike sorumlulu\u011fu, zarar verme olas\u0131l\u0131\u011f\u0131 bir kusura dayanmaks\u0131z\u0131n, \u00e7ok y\u00fcksek olan veya b\u00fcy\u00fck zararlar do\u011furabilecek i\u015fletmeler i\u00e7in s\u00f6z konusu olabilir. Bu sebeplerden dolay\u0131 madencilik faaliyetlerinde baz\u0131 ilkeler benimsenmi\u015ftir. Bunlardan en \u00f6nemlisi \u2018b\u00f6l\u00fcnmezlik ilkesi\u2019 dir. Buna g\u00f6re maden yata\u011f\u0131 bir b\u00fct\u00fcnd\u00fcr, farkl\u0131 k\u0131s\u0131mlar\u0131 i\u00e7in farkl\u0131 ruhsatlarla ayr\u0131 ellerden i\u015fletilmesi m\u00fcmk\u00fcn de\u011fildir. Nitekim bu durum 3213 say\u0131l\u0131 Maden Kanunu 5.maddesinde: \u201cMadenler \u00fczerinde tesis olunan ilk m\u00fcracaat (takadd\u00fcm), arama ruhsatnamesi, buluculuk ve i\u015fletme ruhsat\u0131 haklar\u0131n\u0131n hi\u00e7 birisi hisselere b\u00f6l\u00fcnemez. Her biri bir b\u00fct\u00fcn halinde muameleye tabi tutulur.\u2019\u2019 ifadeleriyle h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. B\u00f6l\u00fcnmezlik ilkesinin kat\u0131l\u0131\u011f\u0131 a\u00e7\u0131\u011fa \u00e7\u0131kabilecek zararlar\u0131n b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fcn yan\u0131 s\u0131ra maden yata\u011f\u0131ndan elde edilecek ekonomik ve kamusal verimin en az kayba u\u011framas\u0131 amac\u0131n\u0131 da ta\u015f\u0131maktad\u0131r. R\u00f6d\u00f6vans S\u00f6zle\u015fmeleri ise bu ilkeye bir alternatif sunmaktad\u0131r. Buna g\u00f6re, maden yata\u011f\u0131n\u0131n ruhsat\u0131na sahip olan ki\u015fi, ruhsat\u0131n kullan\u0131m\u0131n\u0131 ba\u015fka bir \u00f6zel ki\u015fiye devredebilmektedir.<\/p><ul><li><strong>Maden Sicili<\/strong><br \/>T\u00fcrk hukukunda iki t\u00fcr maden ruhsat\u0131 bulunmaktad\u0131r: arama ruhsat\u0131 ve i\u015fletme ruhsat\u0131. Bu ruhsatlar\u0131n takibi amac\u0131yla Maden Sicili tutulmakta olup, sicilin aleniyeti \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin ruhsat durumunu \u00f6\u011frenebilmesi i\u00e7indir. R\u00f6dovans S\u00f6zle\u015fmelerinin sicile \u015ferhine ili\u015fkin ise Maden Kanunu madde 101\u2019de s\u00f6zle\u015fmenin bilgi ama\u00e7l\u0131 \u015ferhi zorunludur, denmi\u015ftir. Hukuk Genel Kurulu, E. 2006\/617 K. 2006\/642 T. 11.10.2006 ilam\u0131nda: \u201cTaraflar aras\u0131ndaki s\u00f6zle\u015fmenin maden siciline tescili zorunlulu\u011fu bulunmay\u0131p, tescil ancak madendeki devlet hakk\u0131n\u0131n takibi a\u00e7\u0131s\u0131ndan h\u00fck\u00fcm ifade etmektedir. O halde mahkemece herhangi bir \u015fekil \u015fart\u0131na tabi olmayan r\u00f6dovans s\u00f6zle\u015fmesine dayal\u0131 davac\u0131 taleplerinin de\u011ferlendirilmesi gerekir iken, somut olayda uygulama yeri bulunmayan Maden Kanunu\u2019nun 38.maddesine g\u00f6re s\u00f6zle\u015fmenin maden siciline kaydedilmedi\u011fi gerek\u00e7esiyle davan\u0131n reddi do\u011fru g\u00f6r\u00fclmemi\u015f, karar\u0131n bu nedenle dahi bozulmas\u0131 gerekmi\u015ftir.\u201d \u015feklinde h\u00fck\u00fcm verilmi\u015f ve emsal karar olu\u015fturulmu\u015ftur. B\u00fct\u00fcn bu a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda, r\u00f6d\u00f6vans s\u00f6zle\u015fmelerinin MAPEG taraf\u0131ndan izinli olmas\u0131 zorunluyken bu iznin Maden Siciline \u015ferhinin bilgi ama\u00e7l\u0131 oldu\u011fu s\u00f6ylenebilir.<\/li><\/ul><p style=\"padding-left: 40px;\">Maden siciline \u015ferh verilmesi, bir zarar meydana geldi\u011finde sorumlulu\u011fun kimde oldu\u011funun tespit edilmesi a\u00e7\u0131s\u0131ndan da b\u00fcy\u00fck \u00f6nem ta\u015f\u0131makta olup tehlike sorumlulu\u011fu kapsam\u0131nda do\u011fru bir belirleme yap\u0131lmas\u0131, zarar\u0131n giderilmesi ve hukuki s\u00fcre\u00e7lerin y\u00f6netimi i\u00e7in kritik bir rol oynamaktad\u0131r. 5995 say\u0131l\u0131 Kanun ile Maden Hukuku Kanununa eklenen 5995 Ek 7. Maddesinde: \u201cMaden ruhsat sahiplerinin, ruhsat sahalar\u0131n\u0131n bir k\u0131sm\u0131nda veya tamam\u0131nda \u00fc\u00e7\u00fcnc\u00fc ki\u015filerle yapm\u0131\u015f olduklar\u0131\u00a0r\u00f6d\u00f6vans\u00a0s\u00f6zle\u015fmelerinde, bu alanlarda yap\u0131lacak madencilik faaliyetlerinden do\u011facak \u0130\u015f Kanunu, i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi ile ilgili idari, mali ve hukuki sorumluluklar\u00a0r\u00f6d\u00f6vans\u00e7\u0131ya\u00a0aittir. Ancak bu durum ruhsat sahibinin Maden Kanunundan do\u011fan sorumluluklar\u0131n\u0131 ortadan kald\u0131rmaz.\u201d denilerek madencilik faaliyetleri sebebiyle do\u011facak uyu\u015fmazl\u0131klarda sorumlulu\u011fun r\u00f6d\u00f6vans\u00e7\u0131ya ait oldu\u011fu ancak bu durumun ruhsat sahibinin sorumlulu\u011funu ortadan kald\u0131rmayaca\u011f\u0131 a\u00e7\u0131k\u00e7a h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p><p>\u00a0<\/p><p style=\"padding-left: 40px;\"><strong>R\u00d6D\u00d6VANS S\u00d6ZLE\u015eMES\u0130N\u0130N D\u00dcZENLENMES\u0130, KURUMA \u0130ZN\u0130 VE \u015eARTLARI<\/strong><\/p><p>\u00a0<\/p><ul><li><strong>Talep ve Ba\u015fvuru<\/strong><br \/>R\u00f6dovans s\u00f6zle\u015fmesi, maden ruhsat\u0131n\u0131n devrini de\u011fil, bu hakk\u0131n bir ba\u015fkas\u0131na belirli bir s\u00fcreyle kulland\u0131r\u0131lmas\u0131n\u0131 ifade etti\u011finden, ayr\u0131ca bu s\u00f6zle\u015fmenin \u015fekline ili\u015fkin ba\u015fkaca kanun\u00ee bir d\u00fczenleme de bulunmad\u0131\u011f\u0131ndan r\u00f6d\u00f6vans s\u00f6zle\u015fmesinin TBK madde 12 gere\u011fi herhangi bir \u015fekle t\u00e2bi olmad\u0131\u011f\u0131 ifade edilmelidir. Her ne kadar r\u00f6d\u00f6vans s\u00f6zle\u015fmesinin taraf\u0131 olmak i\u00e7in bir \u015fekil \u015fart\u0131 \u00f6ng\u00f6r\u00fclmemi\u015fse de s\u00f6zle\u015fmenin kurulabilmesi i\u00e7in MAPEG taraf\u0131ndan onaylanmas\u0131, bunun i\u00e7inse zorunlu olan baz\u0131 i\u015f ve belgelerin teslimi gereklidir. Taraflar\u0131n irad\u00ee \u015fekil \u00e7er\u00e7evesinde, bu s\u00f6zle\u015fmeyi diledikleri herhangi bir \u015fekle t\u00e2bi k\u0131lmalar\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu ba\u011flamda, taraflar\u0131n iradesi ile r\u00f6d\u00f6vans s\u00f6zle\u015fmesi, basit yaz\u0131l\u0131 \u015fekle t\u00e2bi k\u0131l\u0131nabilece\u011fi gibi, s\u00f6zle\u015fmeye noterlik\u00e7e d\u00fczenleme ya da onaylama \u015feklinde resmiyet kazand\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcnd\u00fcr.<ul><li>\u0130\u015fletme ruhsatlar\u0131 i\u00e7in yap\u0131lan r\u00f6d\u00f6vans m\u00fcracaatlar\u0131nda verilmesi gereken belgeler ve m\u00fcracaat\u0131n ge\u00e7erli olmas\u0131 i\u00e7in sa\u011flanmas\u0131 gereken kriterler \u00f6zetle a\u015fa\u011f\u0131daki gibidir;<\/li><li>Talebe konu belgelerin \u201cE-Maden \u2013 R\u00f6d\u00f6vans Talebi\u201d sekmesinden talep yap\u0131larak sisteme y\u00fcklenmesi,<\/li><li>Talebe konu i\u015fletme ruhsat\u0131n\u0131n t\u00fcm \u00f6demelerinin yap\u0131lm\u0131\u015f olmas\u0131<\/li><li>\u0130\u015fletme izni olan ruhsatlarda; talep tarihi itibariyle daimi nezaret\u00e7i atamas\u0131n\u0131n yap\u0131lm\u0131\u015f olmas\u0131 ve ruhsat \u00fczerinde aktif bir YTK atamas\u0131n\u0131n bulunmas\u0131,<\/li><li>\u0130\u015fletme izni olan ruhsatlarda; ruhsat sahibi ve r\u00f6d\u00f6vans\u00e7\u0131 \u015firketlere ait aktif edilmi\u015f tebligata esas KEP ve UETS adreslerinin bulunmas\u0131,<\/li><li>Ba\u015flang\u0131\u00e7 ve biti\u015f tarihinin belirli oldu\u011fu bir r\u00f6d\u00f6vans s\u00f6zle\u015fmesinin asl\u0131n\u0131n veya \u0131slak imzal\u0131 noter onayl\u0131 \u00f6rne\u011fi,<\/li><li>R\u00f6d\u00f6vans s\u00f6zle\u015fmesinde, r\u00f6d\u00f6vansla \u00e7al\u0131\u015f\u0131lacak alan\u0131n paftas\u0131, koordinatlar\u0131 ve \u00e7izimi(ek olarak) a\u00e7\u0131k\u00e7a belirtilecektir.<\/li><li>R\u00f6d\u00f6vans\u00e7\u0131 ve ruhsat sahibi ve varsa ortaklar\u0131 ile ilgili gerekli bilgileri g\u00f6sterir nitelikte Ticaret Sicil M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden MAPEG\u2019e verili\u015f tarihi itibariyle son 15 g\u00fcn i\u00e7erisinde al\u0131nacak olan \u201cFirma Durum Belgesi\u201d<\/li><li>R\u00f6d\u00f6vans\u00e7\u0131 \u015firketin mali yeterlilik \u015fartlar\u0131n\u0131 sa\u011flad\u0131\u011f\u0131na dair ilgili finans kurumlar\u0131ndan al\u0131nan belgelerin e-Maden sistemi \u00fczerinden sisteme tan\u0131mlanmas\u0131 gerekmektedir.<\/li><\/ul><\/li><\/ul><p style=\"padding-left: 40px;\">\u00a0<\/p><ul><li><strong>R\u00f6d\u00f6vans Alanda Aranan Nitelikler<\/strong><br \/>Maden Y\u00f6netmeli\u011finin R\u00f6d\u00f6vans \u0130\u015flemleri ba\u015fl\u0131kl\u0131 m.101\u2019de r\u00f6d\u00f6vans\u00e7\u0131 olarak faaliyet g\u00f6sterecek t\u00fczel ki\u015filerin; Maden Kanunu m. 6 uyar\u0131nca maden haklar\u0131n\u0131 kullanma ile ilgili \u015fartlar\u0131 ve bu Y\u00f6netmelikte belirlenen mali yeterlilik \u015fartlar\u0131n\u0131 sa\u011flamas\u0131 ve EK-2\u2019de yer alan mali yeterlilik tutarlar\u0131na uygun banka referans mektubu sa\u011flamas\u0131, ger\u00e7ek ki\u015filerinse \u00a0mali yeterlilik tutar\u0131n\u0131n tamam\u0131n\u0131 banka referans mektubuyla sa\u011flamas\u0131 ve s\u00f6z konusu referans mektubunun Genel M\u00fcd\u00fcrl\u00fc\u011fe verili\u015f tarihi itibar\u0131yla son on be\u015f g\u00fcn i\u00e7inde al\u0131nm\u0131\u015f olmas\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/li><li><strong>\u00c7ed Raporu<\/strong><br \/>Yap\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen t\u00fcm projelerde \u00e7evreye kar\u015f\u0131 olma ihtimali bulunan zararlar\u0131n hesap edilmesi, al\u0131nacak \u00f6nlemlerin tespiti veya asgari d\u00fczeye indirilmesi \u00e7al\u0131\u015fmalar\u0131n\u0131n tamam\u0131na \u00e7evresel etki de\u011ferlendirilmesi ad\u0131 verilmektedir. Bu de\u011ferlendirmeleri i\u00e7eren rapor ise \u00c7ed Raporu\u2019dur. Bu rapor ilgili proje sahiplerince, incelenmek \u00fczere \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019na sunulur. \u00d6zel format\u0131nda haz\u0131rlanan \u00c7ed Raporunun uygunlu\u011funun Bakanl\u0131k\u00e7a incelenmesi ve uygun g\u00f6r\u00fclmesi durumunda projenin y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc valilere iletilmesi s\u00fcreci izlenir.<\/li><li><strong>Projelerin Haz\u0131rlanmas\u0131<\/strong><br \/>Madencilik projelerinin de\u011ferlendirilme s\u00fcreci, \u00e7e\u015fitli ad\u0131mlar\u0131 gerektirmektedir. S\u00f6z konusu s\u00fcre\u00e7ler, cevher yata\u011f\u0131n\u0131n fark edilmesinden nihai karara kadar bir dizi \u00e7al\u0131\u015fmay\u0131 i\u00e7erir ve en ufak bir hatan\u0131n bile \u00e7ok a\u011f\u0131r sonu\u00e7lar\u0131 olaca\u011f\u0131ndan her a\u015faman\u0131n sonunda geriye d\u00f6n\u00fck bir dizi kontrol yap\u0131lmaktad\u0131r.<\/li><li><strong>\u00dcretim Kapasitesi Zorunlulu\u011fu<\/strong><br \/>Maden Projeleri izinleri al\u0131n\u0131rken gerekli belge ve i\u015flemlerde sunulan proje detaylar\u0131yla birlikte tahmini \u00fcretim miktarlar\u0131 da Genel M\u00fcd\u00fcrl\u00fc\u011fe ula\u015fmaktad\u0131r. \u0130zinlerin al\u0131nmas\u0131ndan itibaren i\u015fletme izni verilir. Bu iznin verildi\u011fi tarihten itibaren bir y\u0131ll\u0131k s\u00fcre i\u00e7inde ruhsat sahibi madeni i\u015fletmeye almak zorundad\u0131r. Bu s\u00fcrede i\u015fletmeye al\u0131nmayan ruhsat sahalar\u0131nda, \u00e7al\u0131\u015f\u0131lmayan her y\u0131l i\u00e7in, projede belirtilen \u00fcretim miktar\u0131n\u0131n % 10&#8217;u \u00fczerinden Devlet hakk\u0131 al\u0131n\u0131r.<\/li><li><strong>S\u00fcre S\u0131n\u0131r\u0131<\/strong><br \/>R\u00f6d\u00f6vans S\u00f6zle\u015fmelerinin s\u00fcresi i\u00e7in kanun kapsam\u0131nda, do\u011frudan bir s\u00fcre s\u0131n\u0131r\u0131 yer almamakla birlikte, maden ruhsatlar\u0131n\u0131n kendine \u00f6zg\u00fc s\u00fcreleri bulunmaktad\u0131r ve r\u00f6d\u00f6vans s\u00f6zle\u015fmesi bu ruhsat s\u00fcrelerini a\u015famaz. \u00d6rne\u011fin, i\u015fletme ruhsatlar\u0131 i\u00e7in verilen s\u00fcre genellikle 10 ila 60 y\u0131l aras\u0131nda de\u011fi\u015febilmektedir. Dolay\u0131s\u0131yla, r\u00f6d\u00f6vans s\u00f6zle\u015fmesinin s\u00fcresi de ruhsat s\u00fcresine ba\u011fl\u0131 olarak belirlenebilir. R\u00f6d\u00f6vans S\u00f6zle\u015fmesi uzat\u0131lmak istendi\u011fi durumda ruhsat s\u00fcresi dolmu\u015f ise \u00f6nce ruhsat s\u00fcresinin uzat\u0131lmas\u0131 gereklidir. Maden Y\u00f6netmeli\u011fi Madde 101: \u201cRuhsat\u0131n sicil kay\u0131tlar\u0131na bilgi ama\u00e7l\u0131 \u015ferh edilmi\u015f r\u00f6d\u00f6vans s\u00f6zle\u015fmelerinde, r\u00f6d\u00f6vans s\u00fcresinin uzat\u0131lmas\u0131 ve\/veya r\u00f6d\u00f6vans s\u00f6zle\u015fmesindeki alan\u0131n koordinatlar\u0131n\u0131n de\u011fi\u015ftirilmesi durumlar\u0131 yeni talep olarak de\u011ferlendirilir.\u201d h\u00fckm\u00fc s\u00f6zle\u015fmenin s\u00fcresinin uzat\u0131lmas\u0131 i\u00e7in Genel M\u00fcd\u00fcrl\u00fck\u00e7e yeni bir onay\u0131n gerekli oldu\u011funu ifade etmektedir.<\/li><\/ul><p>\u00a0<\/p><p>Sonu\u00e7 olarak R\u00f6d\u00f6vans s\u00f6zle\u015fmeleri, maden hukuku \u00e7er\u00e7evesinde maden yataklar\u0131n\u0131n etkin ve d\u00fczenli bir \u015fekilde i\u015fletilmesine olanak tan\u0131r. Bu s\u00f6zle\u015fmeler, maden ruhsat sahiplerine madenlerin kullan\u0131m\u0131 konusunda b\u00f6l\u00fcnmezlik ilkesinin kat\u0131l\u0131\u011f\u0131na bir esneklik sa\u011flarken, maden i\u015fletmecilerine de yat\u0131r\u0131mlar\u0131n\u0131 kar\u015f\u0131layacak ve ekonomik kazan\u00e7 elde edebilecekleri bir f\u0131rsat sunar. \u0130dare hukuku ve \u00f6zel hukuk aras\u0131ndaki s\u0131n\u0131rda yer alan r\u00f6d\u00f6vans s\u00f6zle\u015fmeleri, hukuki niteli\u011fi a\u00e7\u0131s\u0131ndan farkl\u0131 g\u00f6r\u00fc\u015fleri bar\u0131nd\u0131rsa da, uygulama ile h\u00e2lihaz\u0131rda \u015fekillenmeye devam etmektedir. R\u00f6d\u00f6vans s\u00f6zle\u015fmelerinde sorumluluk payla\u015f\u0131m\u0131 ve y\u00fck\u00fcml\u00fcl\u00fcklerin belirlenmesi maden ve di\u011fer mevzuat uyar\u0131nca ruhsata ba\u011fl\u0131 b\u00fct\u00fcn y\u00fck\u00fcml\u00fcl\u00fckler ruhsat sahibine aittir. R\u00f6d\u00f6vans s\u00f6zle\u015fmesi kurulabilmesi i\u00e7in bir \u015fekil \u015fart\u0131 kanunlarda \u00f6ng\u00f6r\u00fclm\u00fc\u015f olmasa da uygulamada s\u00f6zle\u015fme izninin al\u0131nabilmesi i\u00e7in baz\u0131 ba\u015fvurular\u0131n yap\u0131lmas\u0131yla \u00c7ed Raporu\u2019nun haz\u0131rlanmas\u0131 ve belgelerin MAPEG\u2019e teslimi gerekmektedir.
