CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA

As Protokol Law & Consultancy Office, we prioritize the protection of privacy and the confidentiality of personal data. Acting as the data controller, Protokol Law & Consultancy Office (hereinafter referred to as Protokol Law & Consultancy), we would like to inform you about the processing of your personal data in accordance with the Personal Data Protection Law No. 6698 and the relevant legislation.

Within the scope of our obligation to inform, we would like to inform you through this disclosure statement about the purposes for which your personal data will be processed, to whom and for what purposes it may be transferred, the methods of collection, legal grounds, and your rights.

Data Controller

Protokol Law and Consultancy has the title of data controller regarding the processing of personal data (any information relating to an identified or identifiable natural person) within the scope of Personal Data Protection Law (KVKK).

“Purposes for Processing Your Personal Data
In accordance with Article 20 of the Constitution of the Republic of Turkey and Article 4 of the Personal Data Protection Law (KVKK), your personal data is processed by Protokol Law & Consultancy, in its capacity as the data controller, for the following purposes:

  • Providing the services you have requested based on your needs,
  • Planning commercial and/or legal business strategies,
  • Conducting client meetings, preparing legal reports, and reviewing proposals for legal services within our law firm,
  • Managing the information security process,
  • Establishing and/or performing legal consultancy agreements,
  • Managing client relations processes,
  • Managing contract processes and identifying and verifying the authority of signatories for relevant documents,
  • Recording and organizing the necessary identity, address, tax number, and other information required to determine the owners and counterparts of all transactions and procedures, either on paper or in electronic form,
  • Providing information to authorized courts, enforcement offices, institutions, and/or organizations,
  • Evaluating candidates during recruitment processes,
  • Providing updates on legal developments and changes in legislation

All of the above are carried out in compliance with the personal data processing conditions stipulated in Articles 5 and 6 of the Personal Data Protection Law.

To Whom Your Personal Data is Transferred and Purposes of Transfer

Your personal data may be transferred to third-party companies from which we receive services, support, or consultancy, and to authorized public institutions and organizations within the country, only if it is necessary to fulfill the purposes of processing your personal data as outlined above, and in accordance with Article 8 of the Personal Data Protection Law.

Your personal data may be shared with the competent authorities within the scope of requests from the authorities authorized to request your information within the framework of the legislation and in case of disputes.

Our computer systems and infrastructures are kept in Turkey and transfer of your personal data abroad is not possible as a rule.

Methods and Legal Reasons for Collecting Your Personal Data

Your personal data is collected or processed verbally, in writing, or electronically through physical or telephone meetings and discussions with you, via information and documents that you physically provide to us, or via information and documents that you send electronically by email or fax.

Your personal data processed for providing information to authorized persons, institutions and organizations for reasons arising from the legislation is processed within the scope of the legal reason that it is clearly stipulated in the laws in accordance with the relevant law regulating the obligation to provide information and Article 5/2 (a) of the Personal Data Protection Law and that it is mandatory for the data controller to fulfill its legal obligations in accordance with Article 5/2 (ç) of the same law.

Your personal data, which is processed for the purposes of managing human resources processes, ensuring the accuracy and currency of data, preventing data loss through copying/backup, and managing system and physical security processes, is processed based on the data controller’s legitimate interests under Article 5/2(f) of the Personal Data Protection Law provided that such processing does not harm the fundamental rights and freedoms of the data subject.

Your personal data processed in order to fulfill the obligations arising from the employment contract and occupational health and safety obligations are processed in accordance with the Labor Law, Social Security and General Health Insurance and the relevant legislation and the legal reasons that it is clearly stipulated in the laws in accordance with Article 5/2 (a) of the Personal Data Protection Law, that it is mandatory for the data controller to fulfill its legal obligations in accordance with Article 5/2 (ç) and that data processing is mandatory for the establishment, exercise or protection of a right in accordance with Article 5/2 (e) of the same law.

Your Rights Regarding Your Personal Data

We would like to remind you that you have the following rights pursuant to Article 11 of the Law:

– To learn whether your personal data is being processed,
– Request information if processed,
– To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
– To know the third parties to whom your personal data is transferred,
– To request correction of your personal data in case of incomplete or incorrect processing, and to request that this situation be notified to third parties to whom your personal data has been transferred if you exercise this right,
– To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Personal Data Protection Law, and if you exercise this right, to request that this situation be notified to third parties to whom your personal data is transferred,
– To object to the result about you through the analysis of the processed data by automated systems,
– You have the right to claim compensation in case you suffer damage due to the processing of personal data in violation of the Personal Data Protection Law.
