G\u00f6nderilen ihtarname daha sonradan a\u00e7\u0131lacak dava i\u00e7in delil niteli\u011fi ta\u015f\u0131yaca\u011f\u0131ndan ihtarnamelerin noter arac\u0131l\u0131\u011f\u0131yla g\u00f6nderilmesi ispat a\u00e7\u0131s\u0131ndan \u00f6nem arz eder.<\/li><li>\u0130kinci yol ise kirac\u0131ya kar\u015f\u0131 dava a\u00e7maks\u0131z\u0131n tahliye talepli icra takibi ba\u015flatmakt\u0131r. Tahliye talepli icra takibi ba\u015flat\u0131ld\u0131ktan sonra kirac\u0131 bor\u00e7luya \u00f6deme emri g\u00f6nderilir. \u00d6deme emri ile \u00f6deme emrinin bor\u00e7luya tebli\u011finden itibaren 7 g\u00fcn (6 aydan k\u0131sa kira s\u00f6zle\u015fmelerinde 3 g\u00fcn) i\u00e7inde borca itiraz edilmezse ve 30 g\u00fcn i\u00e7inde \u00f6deme yap\u0131lmazsa kira alaca\u011f\u0131 kesinle\u015fir ve kiralayan (alacakl\u0131) icra mahkemesinde bor\u00e7lunun ta\u015f\u0131nmazdan tahliyesini isteyebilecektir (\u0130\u0130K 269).<\/li><li>Temerr\u00fct nedeniyle tahliye davas\u0131 a\u00e7\u0131lmas\u0131. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 315. maddesi uyar\u0131nca kirac\u0131 vadesi geldi\u011fi halde kira borcunu \u00f6demezse kiraya veren kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verir ve bu s\u00fcrede de kira bedeli \u00f6denmezse s\u00f6zle\u015fmeyi feshedece\u011fini bildirebilir. Konut ve \u00e7at\u0131l\u0131 i\u015f yeri i\u00e7in verilecek s\u00fcre 30 g\u00fcnden az olamaz. O halde, kiraya veren kirac\u0131ya ihtarname ile 30 g\u00fcn i\u00e7inde \u00f6deme yapmas\u0131 gerekti\u011fini aksi halde s\u00f6zle\u015fmeyi feshedece\u011fini bildirir.<\/li><\/ul><p>\u0130htarname g\u00f6nderildikten sonra kirac\u0131 30 g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde kira bedellerini \u00f6demez ise; kiraya veren taraf\u0131ndan ba\u015fkaca bir ihtara gerek kalmaks\u0131z\u0131n ve kira d\u00f6neminin sonu beklenmeksizin temerr\u00fct nedeniyle tahliye davas\u0131 a\u00e7\u0131labilir. Temerr\u00fct nedeniyle a\u00e7\u0131lan tahliye davas\u0131 sonucunda verilen karar ile kiraya vere cebri icra yolu ile icra dairesinde gerekli tahliye i\u015flemlerini ba\u015flatabilir<\/p><p><\/p><p><strong>TAHL\u0130YE DAVALARINDA G\u00d6REVL\u0130 VE YETK\u0130L\u0130 MAHKEME<\/strong><\/p><p>\u0130ki hakl\u0131 ihtarname g\u00f6nderilmesi suretiyle a\u00e7\u0131lacak olan tahliye davas\u0131 i\u00e7in ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer Sulh Hukuk Mahkemesi g\u00f6revlidir.\u00a0Tahliye talepli olarak ba\u015flat\u0131lan icra takibi neticesinde a\u00e7\u0131lacak olan tahliye davas\u0131 ise ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer \u0130cra Hukuk Mahkemesinde a\u00e7\u0131lmal\u0131d\u0131r.
