Bunlar:<\/p><p><strong>\u00a0\u00a0 &#8211;<\/strong>Zarara yol a\u00e7an etkinli\u011fin, ayr\u0131lmas\u0131na olanak bulunmayacak bi\u00e7imde kamu hizmetine ba\u011fl\u0131 olmas\u0131 ve<\/p><p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 -Zarar\u0131n ki\u015fisel kusurdan de\u011fil, hizmetin kurulu\u015f ve i\u015fleyi\u015finde ortaya \u00e7\u0131kan d\u00fczensizlikten kaynaklanmas\u0131d\u0131r. Di\u011fer bir deyi\u015fle hizmet kusurunun varl\u0131\u011f\u0131, kamu personelinin kusuruna ba\u011fl\u0131 de\u011fil; hizmetin kusurlu olmas\u0131na ba\u011fl\u0131d\u0131r.<\/p><p><\/p><p>\u0130darenin, hizmet kusurundan do\u011fan zararlardan do\u011fan sorumlulu\u011fu asli ve birinci derecedendir. Dan\u0131\u015ftay da verdi\u011fi bir kararda, \u201cHizmet kusurundan dolay\u0131 sorumluluk, idarenin sorumlulu\u011funun do\u011frudan do\u011fruya ve asli nedenini olu\u015fturur\u201d diyerek bu ilkeyi vurgulam\u0131\u015ft\u0131r. Bu nedenle, hizmet kusuru nedeniyle do\u011fan zararlar\u0131n tazmini i\u00e7in a\u00e7\u0131lacak tazminat davalar\u0131, do\u011frudan do\u011fruya idare aleyhine a\u00e7\u0131lacakt\u0131r.<\/p><p><\/p><p>Dan\u0131\u015ftay bir ba\u015fka karar\u0131nda, bir binaya in\u015faat ruhsat\u0131 veren belediyenin, in\u015faat\u0131n usul\u00fcne uygun \u015fekilde yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n kontrol\u00fcn\u00fcn \u00e7ok uzun s\u00fcre sonra yap\u0131lmas\u0131n\u0131, hizmetin ge\u00e7 i\u015flemesi \u015feklindeki hizmet kusuru olarak de\u011ferlendirmi\u015ftir. Uyu\u015fmazl\u0131k konusu yap\u0131ya zemin+4 normal kat i\u00e7in belediye taraf\u0131ndan in\u015faat ruhsat\u0131 verilmi\u015f, ancak on y\u0131l\u0131 ge\u00e7kin bir s\u00fcre boyunca herhangi bir kontrol veya denetim yap\u0131lmam\u0131\u015f ve 2006 y\u0131l\u0131nda y\u0131k\u0131m tehlikesi alt\u0131nda bulundu\u011fu anla\u015f\u0131lmas\u0131 \u00fczerine binan\u0131n tahliyesi yolunda i\u015flem tesis edilmi\u015ftir. Dan\u0131\u015ftay, s\u00f6z\u00fc edilen yap\u0131n\u0131n ruhsata ayk\u0131r\u0131 olarak 4 kat yerine 8 kat ve fen ve in\u015faat tekniklerine ayk\u0131r\u0131 yap\u0131lmas\u0131, daval\u0131 idarelerin uzunca bir s\u00fcre denetim y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmemesi, b\u00f6ylece hizmetin ge\u00e7 i\u015flemesi nedeniyle zarar\u0131n do\u011fdu\u011funa karar vermi\u015ftir.<\/p><p><\/p><p>Dan\u0131\u015ftay\u2019\u0131n di\u011fer verdi\u011fi kararlara da bak\u0131ld\u0131\u011f\u0131nda, idarenin, \u201cs\u0131nav\u0131 kazanan ve staj\u0131n\u0131 tamamlayan ki\u015fiyi ge\u00e7 atamas\u0131n\u0131\u201d, \u201cin\u015faat\u0131 zaman\u0131nda bitirmemesini\u201d, \u201cbakanlar kurulunun kararnameyi ge\u00e7 \u00e7\u0131karmas\u0131n\u0131\u201d, \u201chastaya ge\u00e7 m\u00fcdahale edilmesini\u201d, \u201cidari i\u015flemleri ve yaz\u0131\u015fmalar\u0131 makul s\u00fcreyi a\u015facak \u015fekilde ge\u00e7 yapmas\u0131n\u0131\u201d hizmetin ge\u00e7 i\u015flemesi olarak de\u011ferlendirilmektedir.<\/p><p><\/p><p>\u0130darenin y\u00fcr\u00fctt\u00fc\u011f\u00fc kamu hizmetlerini tam olarak ve hukuka uygun olarak y\u00fcr\u00fctmesi yeterli olmay\u0131p; idarenin ayn\u0131 zamanda y\u00fcr\u00fctt\u00fc\u011f\u00fc hizmetleri, zaman\u0131nda ve gerekli h\u0131zda yapmas\u0131 zorunludur. Bu, y\u00fcr\u00fct\u00fclen hizmetten beklenen maksimum verimin sa\u011flanmas\u0131 i\u00e7in gereklidir. \u0130\u015fte idarenin y\u00fcr\u00fctt\u00fc\u011f\u00fc hizmeti, mevzuat\u0131n gerektirdi\u011fi s\u00fcrede veya hizmetin gereklerine uygun s\u00fcrede ba\u015flamamas\u0131 veya bitirmemesi hizmetin ge\u00e7 i\u015flemesini olu\u015fturmakta ve bu durum idarenin hizmet kusuru olarak kabul edilmektedir. Ger\u00e7ekten de hizmetin yap\u0131lmas\u0131 ne kadar \u00f6nemliyse, hizmetin zaman\u0131nda ba\u015flamas\u0131 ve zaman\u0131nda bitirilmesi de bir o kadar \u00f6nemlidir.<\/p><p><\/p><p>\u00d6zellikle \u00fclkemizde, son y\u0131llara kadar vatanda\u015flar\u0131n en \u00e7ok \u015fik\u00e2yet etti\u011fi konular\u0131n ba\u015f\u0131nda b\u00fcrokrasinin \u00e7ok yava\u015f i\u015flemesi konusu gelmekteydi. Bilgi ve belge ak\u0131\u015f\u0131n\u0131n h\u0131zland\u0131\u011f\u0131, ileti\u015fimin kolayla\u015ft\u0131\u011f\u0131 g\u00fcn\u00fcm\u00fczde, uzun zaman alan baz\u0131 haberle\u015fmelerin daha k\u0131sa s\u00fcrede \u00e7\u00f6z\u00fcmlenebilir hale geldi\u011fi \u015f\u00fcphesizdir. \u0130dareler taraf\u0131ndan, bu kolayl\u0131\u011f\u0131 hayata ta\u015f\u0131yan teknoloji imk\u00e2nlar\u0131ndan faydalanmak suretiyle, i\u015flemlerin h\u0131zland\u0131r\u0131lmas\u0131n\u0131 sa\u011flayacak \u00e7al\u0131\u015fmalar yap\u0131lmas\u0131 bir zorunluluktur<\/p><p><\/p><p>Sonu\u00e7 olarak idare y\u00fcr\u00fctt\u00fc\u011f\u00fc hizmetleri, varsa mevzuatta belirtilen s\u00fcre de, mevzuatta belirli bir s\u00fcre yoksa hizmetin niteli\u011fi, idarenin sahip oldu\u011fu imk\u00e2nlar ve g\u00fcn\u00fcn \u015fartlar\u0131n\u0131n verdi\u011fi elveri\u015flilik \u00f6l\u00e7\u00fcs\u00fcnde makul bir s\u00fcrede ba\u015flamak ve bitirmek zorundad\u0131r. Bu nedenle, hizmetin ge\u00e7 i\u015fleyip i\u015flemedi\u011fi her somut olay\u0131n kendi \u015fartlar\u0131 ve \u00f6zellikleri g\u00f6z \u00f6n\u00fcnde bulundurularak tespit edilecektir.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f46cb69 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"f46cb69\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Kira s\u00f6zle\u015fmesi, kar\u015f\u0131l\u0131kl\u0131 bor\u00e7 y\u00fckleyen bir s\u00f6zle\u015fme olup s\u00f6zle\u015fmenin her iki taraf\u0131na da yerine getirilmesi gereken edim y\u00fck\u00fcml\u00fcl\u00fckleri y\u00fckler. \u0130\u015fbu kira s\u00f6zle\u015fmesinin en \u00f6nemli unsurlar\u0131ndan birisi kira bedelidir. Kira s\u00f6zle\u015fmelerinde taraflar, kira bedelini s\u00f6zle\u015fme \u00f6zg\u00fcrl\u00fc\u011f\u00fc prensibi \u00e7er\u00e7evesinde serbest\u00e7e belirleyebilirler. Her kira s\u00f6zle\u015fmesinde oldu\u011fu gibi konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131n\u0131n bedeli de s\u00f6zle\u015fme kurulurken s\u00f6zle\u015fme serbestisi \u00e7er\u00e7evesinde taraflarca kararla\u015ft\u0131r\u0131labilir. Buna kar\u015f\u0131l\u0131k, s\u00f6zle\u015fmenin devam\u0131 s\u0131ras\u0131nda s\u00f6zle\u015fmenin zay\u0131f taraf\u0131n\u0131 korumak amac\u0131yla, T\u00fcrk Bor\u00e7lar Kanunu&#8217;nda kira bedelinin belirlenmesine baz\u0131 s\u0131n\u0131rlamalar getirilmi\u015ftir. Bu s\u0131n\u0131rland\u0131rmalar konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131 uygulamas\u0131 bak\u0131m\u0131ndan 2 \u015fekilde kar\u015f\u0131m\u0131za \u00e7\u0131kar: Kiraya verenin fesih hakk\u0131n\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 ve kiraya verenin isteyebilece\u011fi kira bedelinin s\u0131n\u0131rland\u0131r\u0131lmas\u0131.<\/p><p><strong>Kira Bedelinin Belirlenmesi<\/strong><\/p><p>Taraflar, TBK m.344\/1, c.1&#8217;e g\u00f6re yenilenen kira d\u00f6nemlerinde kira bedelini bir \u00f6nceki kira y\u0131l\u0131nda \u00fcretici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla serbest\u00e7e kararla\u015ft\u0131rabilirler. Kanun koyucu \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 esas ald\u0131\u011f\u0131ndan taraflar t\u00fcketici endeksindeki art\u0131\u015f oran\u0131n\u0131 esas alsalar bile, t\u00fcketici endeksindeki art\u0131\u015f oran\u0131, \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 a\u015f\u0131yorsa, yine yasa gere\u011fi \u00fcretici fiyat endeksi esas al\u0131nacakt\u0131r. Bu h\u00fckm\u00fcn uygulama alan\u0131 bir y\u0131ldan uzun s\u00fcreli kira s\u00f6zle\u015fmeleri bak\u0131m\u0131ndan da ge\u00e7erlidir.<\/p><ul><li><em> Be\u015f Y\u0131ldan Uzun S\u00fcreli Kira S\u00f6zle\u015fmelerinde Kira Bedelinin Tespiti<\/em><\/li><\/ul><p>Taraflar\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli bir kira s\u00f6zle\u015fmesinde veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde, yenilenen kira d\u00f6nemlerinde uygulanacak kira bedelindeki art\u0131\u015f\u0131 belirlemediler ise veya art\u0131\u015f\u0131 belirlemi\u015f olsalar bile art\u0131\u015f oran\u0131n\u0131 veya miktar\u0131n\u0131 belirlememi\u015f olmalar\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu durumda, TBK m.344\/3 gere\u011fince taraflar\u0131n anla\u015fma yap\u0131p yapmad\u0131klar\u0131na bak\u0131lmaks\u0131z\u0131n hakim \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131, kiralanan\u0131n durumunu ve emsal kira bedellerini g\u00f6z \u00f6n\u00fcnde bulundurarak hakkaniyete uygun olacak \u015fekilde kira bedelini tespit edecektir. Kiralanan\u0131n durumu de\u011ferlendirilirken kiralanan\u0131n kalitesi, b\u00fcy\u00fckl\u00fc\u011f\u00fc gibi nitelikler g\u00f6z \u00f6n\u00fcnde bulundurulacakt\u0131r. Emsal kira bedelleri de\u011ferlendirilirken ise ola\u011fan \u015fartlar esas al\u0131n\u0131r. Hakim hakkaniyete g\u00f6re de\u011ferlendirme yaparken tespit edece\u011fi kira bedeli, \u00f6nceki kira y\u0131l\u0131n\u0131n \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memelidir. Ancak, alt\u0131nc\u0131 y\u0131ldaki bu belirlemeden sonraki be\u015f y\u0131l\u0131n sonuna kadar kira bedeli, TBK m.344\/2&#8217;de yer alan &#8216;Taraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir.&#8217; h\u00fckm\u00fcnce belirlenir.<\/p><ul><li><em> Kira Bedelinin Yabanc\u0131 Para Olmas\u0131 Durumunda Kira Bedelinin Tespiti<\/em><\/li><\/ul><p>TBK m.344\/4&#8217;e g\u00f6re a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc durumu sakl\u0131 kalmak kayd\u0131yla, s\u00f6zle\u015fmede kira bedeli yabanc\u0131 para olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamaz. Aksi y\u00f6nde yap\u0131lan anla\u015fmalar emredici h\u00fck\u00fcmlere ayk\u0131r\u0131l\u0131k te\u015fkil edece\u011finden kesin h\u00fck\u00fcms\u00fcz olur. Be\u015f y\u0131l\u0131n sonunda kira bedeli tespit edilirken yine TBK m.344\/3 gere\u011fince hakim hakkaniyete g\u00f6re de\u011ferlendirecektir.<\/p><ul><li><em> Belirli S\u00fcreli Kira S\u00f6zle\u015fmelerini Sona Erdirme<\/em><\/li><\/ul><p>Kural olarak, belirli s\u00fcreli kira s\u00f6zle\u015fmelerini sona erdirme olana\u011f\u0131 kirac\u0131ya aittir. Zira, TBK m.347\/1, c.1 ve TBK m.347\/1, c.2 h\u00fck\u00fcmleri bu y\u00f6ndedir. Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 bak\u0131m\u0131ndan kira bedelinin belirlenmesine kiraya veren bak\u0131m\u0131ndan s\u0131n\u0131r getiren TBK m.347&#8217;ye g\u00f6re kirac\u0131 belirli s\u00fcreli s\u00f6zle\u015fmenin bitiminden on be\u015f g\u00fcn \u00f6nce kiraya verene bildirimde bulunmad\u0131\u011f\u0131 takdirde s\u00f6zle\u015fme bir y\u0131l i\u00e7in uzat\u0131lm\u0131\u015f say\u0131laca\u011f\u0131 gibi kiraya veren s\u00f6zle\u015fme s\u00fcresinin sona erdi\u011fine dayanarak s\u00f6zle\u015fmeyi sona erdiremez (Yarg\u0131tay Hukuk Genel Kurulu E. 2020\/8-242, K. 2020\/712).<\/p><ul><li><em> S\u00f6zle\u015fmenin Bildirimli Feshi<\/em><\/li><\/ul><p>Buna kar\u015f\u0131l\u0131k, kira s\u00f6zle\u015fmesinin on y\u0131ll\u0131k uzama s\u00fcresini ge\u00e7mesi durumunda kiraya verenin bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunarak hi\u00e7bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir. Yine belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde kiraya veren, kira ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra genel h\u00fck\u00fcmlere g\u00f6re belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kira s\u00fcresi bitiminden en az 15 g\u00fcn \u00f6nce yaz\u0131l\u0131 olarak bildirimde bulunulmal\u0131d\u0131r.
