Kararla\u015ft\u0131r\u0131lan s\u00fcrenin ge\u00e7mesiyle herhangi bir bildirim olmaks\u0131z\u0131n sona erecek olan kira s\u00f6zle\u015fmesine belirli s\u00fcreli kira s\u00f6zle\u015fmesi denir. Belirli bir s\u00fcre belirtilmeksizin yap\u0131lan kira s\u00f6zle\u015fmelerine ise belirsiz s\u00fcreli kira s\u00f6zle\u015fmesi ad\u0131 verilir.<\/span><\/p><p class=\"s5\"><span class=\"s6\">Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde taraflardan her biri, daha uzun bir fesih bildirim s\u00fcresi veya ba\u015fka bir fesih d\u00f6nemi kararla\u015ft\u0131r\u0131lm\u0131\u015f olmad\u0131k\u00e7a, yasal fesih d\u00f6nemlerine ve fesih bildirim s\u00fcrelerine uyarak s\u00f6zle\u015fmeyi feshedebilir. Fesih d\u00f6nemlerinin hesab\u0131nda kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihi esas al\u0131n\u0131r.<\/span><\/p><p class=\"s5\"><span class=\"s6\">Konut ki\u015filerin s\u00fcrekli ya\u015fama gayesiyle edindikleri, bar\u0131nmalar\u0131na, yeme- i\u00e7melerine imk\u00e2n sa\u011flayan mahremiyetini ya\u015famak i\u00e7in se\u00e7ti\u011fi ta\u015f\u0131nmaz yap\u0131d\u0131r. Bu yap\u0131n\u0131n toprakla sa\u011flam ve s\u00fcrekli ba\u011flant\u0131 i\u00e7inde olmas\u0131 gerekir. Bu \u015fekilde kolayl\u0131kla s\u00f6k\u00fcl\u00fcp al\u0131nabilecek ve toprakla s\u00fcrekli bir ba\u011flant\u0131s\u0131 olmayan \u00e7ad\u0131r, baraka gibi hafif yap\u0131lar ve karavan gibi ara\u00e7lar konut olarak say\u0131lmamaktad\u0131r.<\/span><span class=\"s6\"> Ancak konut denildi\u011fi zaman akla sadece al\u0131\u015fagelmi\u015f daire gelmemelidir. Bir ta\u015f\u0131nmaz\u0131n banyosu, mutfa\u011f\u0131 ve hatta yap\u0131 kullanma izninin olmamas\u0131 s\u00f6z konusu ta\u015f\u0131nmaz\u0131n konut say\u0131lmas\u0131na engel te\u015fkil etmez. Kanun kuyucu \u00e7at\u0131l\u0131 ifadesine dikkat \u00e7ekerek mutlaka yap\u0131n\u0131n \u00fcst\u00fcn\u00fcn kapal\u0131 olmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r. \u00d6rne\u011fin \u00fcst\u00fc a\u00e7\u0131k otoparklar i\u00e7in \u00e7at\u0131l\u0131 i\u015fyeri h\u00fck\u00fcmleri de\u011fil genel kira s\u00f6zle\u015fmesine ili\u015fkin h\u00fck\u00fcmler uygulanacakt\u0131r. Ayn\u0131 \u015fekilde bir hobinin yap\u0131ld\u0131\u011f\u0131 veya e\u015fyalar\u0131n saklanmas\u0131 amac\u0131yla kullan\u0131lan bir depo bir meslek icra edilmedi\u011fi i\u00e7in genel kira h\u00fck\u00fcmlerine tabi olacakt\u0131r.<\/span><\/p><p class=\"s5\"><span class=\"s6\">Konut ve \u00e7at\u0131l\u0131 i\u015fyerlerinin kira s\u00f6zle\u015fmelerinde kira bedeli, ayl\u0131k net bir rakam\u0131n \u00f6denmesi \u015feklinde belirlenebilece\u011fi gibi, kiran\u0131n belirlenebilir oldu\u011fu ba\u015fka bir \u015fekilde de kiran\u0131n \u00f6denmesi de kararla\u015ft\u0131r\u0131labilir. <\/span><\/p><p class=\"s5\"><span class=\"s2\"><b>Konut ve \u00c7at\u0131l\u0131 \u0130\u015fyeri Kiralar\u0131nda Kira S\u00f6zle\u015fmesinin Sona ermesi<\/b><\/span><\/p><p class=\"s5\"><span>\u00a0<\/span><span style=\"text-decoration: underline;\">1. <span class=\"s7\">Kira s\u00f6zle\u015fmesinin Bildirim Yolu ile Sona Ermesi:<\/span><\/span><span>\u00a0<\/span><\/p><div class=\"s8\"><span class=\"s6\">Kanun Koyucu 6098 Say\u0131l\u0131 Bor\u00e7lar Kanunu ile kiraya verenin kira akdini sona erdirmesini olduk\u00e7a zorla\u015ft\u0131rm\u0131\u015ft\u0131r. Kirac\u0131, belirli s\u00fcreli kira s\u00f6zle\u015fmesini s\u00fcre bitiminden 15 g\u00fcn \u00f6nce yapaca\u011f\u0131 bildirim ile ve hi\u00e7bir hakl\u0131 sebep g\u00f6stermeden feshedebilirken, Kiraya veren, kira s\u00f6zle\u015fmesinin bitti\u011fini gerek\u00e7e g\u00f6stererek kira s\u00f6zle\u015fmesini feshedemez. Ancak kira s\u00f6zle\u015fmesinin 10 y\u0131ll\u0131k uzama s\u00fcresi sonunda her uzama y\u0131l\u0131n\u0131n bitiminden \u00fc\u00e7 ay \u00f6ncesinde g\u00f6nderece\u011fi bildirim ile hi\u00e7bir hakl\u0131 sebep g\u00f6stermeden feshedebilir. Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde de kirac\u0131, s\u00f6zle\u015fmeyi her zaman hi\u00e7bir hakl\u0131 sebep g\u00f6stermeden <\/span><span class=\"s6\">feshedebilir. Kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilir.<\/span><\/div><div><\/div><div class=\"s8\"><span style=\"text-decoration: underline;\">2. <span class=\"s7\">Kira S\u00f6zle\u015fmesinin Dava Yolu ile Sona Ermesi:<\/span><\/span><\/div><p class=\"s9\"><\/p><p class=\"s9\"><span class=\"s6\">T\u00fcrk Bor\u00e7lar Kanunu m. 350&#8217;de &#171;Kiraya veren, kira s\u00f6zle\u015fmesini; kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.&#187; h\u00fckm\u00fc haizdir. \u0130lgili kanun h\u00fckm\u00fc ile tahliye davas\u0131n\u0131n kira s\u00f6zle\u015fmesinin sona erme tarihinden itibaren bir ay i\u00e7inde a\u00e7\u0131laca\u011f\u0131, h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/span><\/p><p class=\"s9\"><span class=\"s6\">K<\/span><span class=\"s6\">irac\u0131n\u0131n belirli kira s\u00f6zle\u015fmesinin sonunda ve belirsiz kira s\u00f6zle\u015fmesinin her an\u0131nda s\u00f6zle\u015fmeyi feshetmek i\u00e7in hakl\u0131 bir sebep g\u00f6stermesine gerek yok iken kiraya veren, 10 y\u0131ldan az s\u00fcreli kira s\u00f6zle\u015fmesini <\/span><span class=\"s6\">feshetmek<\/span><span class=\"s6\"> i\u00e7in hakl\u0131 sebebinin olmas\u0131 gerekir. Kanun Koyucu bu sebepleri tek tek sayarak s\u0131n\u0131rland\u0131rm\u0131\u015ft\u0131r<\/span><span class=\"s6\">;<\/span><\/p><p class=\"s9\" style=\"padding-left: 40px;\"><span>\u00a0<\/span><span class=\"s10\">\u2022 <\/span><span class=\"s6\">Kiraya v<\/span><span class=\"s6\">erenin, Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa,<\/span><\/p><p class=\"s9\" style=\"padding-left: 40px;\"><span class=\"s10\">\u2022 <\/span><span class=\"s6\">Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise,<\/span><\/p><div class=\"s11\" style=\"padding-left: 40px;\"><span class=\"s10\">\u2022 <\/span><span class=\"s6\">Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir.<\/span><\/div><p class=\"s5\" style=\"padding-left: 40px;\"><span>\u00a0<\/span><\/p><p class=\"s5\"><span class=\"s6\">T\u00fcrk Bor\u00e7lar Kanunu\u2019nda, belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde oldu\u011fu gibi, belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde de kiraya verenin bildirimle sona erdirmesine ili\u015fkin h\u00fck\u00fcmlere yer verilmi\u015ftir. TBK m.347\/2\u2019e g\u00f6re, \u201c<\/span><span class=\"s12\">Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman, kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilir<\/span><span class=\"s6\">.\u201d denmektedir. Kira s\u00f6zle\u015fmesinin <\/span><span class=\"s6\">ba\u015flang\u0131\u00e7 an\u0131ndan<\/span><span class=\"s6\">itibaren<\/span><span class=\"s6\"> olmak \u00fczere<\/span><span class=\"s6\"> on y\u0131l dolmadan<\/span><span class=\"s6\"> \u00f6nce<\/span><span class=\"s6\"> kiraya verenin sebep<\/span><span class=\"s6\">siz bir \u015fekilde s\u00f6zle\u015fmeyi <\/span><span class=\"s6\">sona erdirme hakk\u0131 yoktur. Fesih d\u00f6neminin hesab\u0131nda, kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihi esas al\u0131nmaktad\u0131r. <\/span><span class=\"s6\">\u0130htiya\u00e7 nedeniyle tahliye davas\u0131nda ileri s\u00fcr\u00fclen ihtiyac\u0131n; samimi, zorunlu, ger\u00e7ek ve s\u00fcrekli olmas\u0131 gerekmektedir.<\/span><\/p><p class=\"s5\"><span>\u00a0<\/span><span class=\"s6\">T\u00fcrk bor\u00e7lar Kanunu\u2019nun 329. Maddesi uyar\u0131nca <\/span><span class=\"s6\">davac\u0131 kiraya veren taraf\u0131ndan ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7\u0131labilmesi i\u00e7in belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde 6 ayl\u0131k yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan 3 ay \u00f6ncesinde yaz\u0131l\u0131 fesih bildiriminde bulunulmas\u0131 gerekmektedir.<\/span><\/p><p class=\"s5\"><span>\u00a0<\/span><span class=\"s6\">Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde ise, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 347. Maddesi uyar\u0131nca, <\/span><span class=\"s6\">\u00f6zle\u015fmenin sona ermesinden 15 g\u00fcn \u00f6ncesinde kiraya veren taraf\u0131ndan yaz\u0131l\u0131 fesih bildiriminde <\/span><span class=\"s6\">bulunulmas\u0131<\/span><span class=\"s6\"> gerekmekte<\/span><span class=\"s6\">dir.<\/span><\/p><p class=\"s5\"><span class=\"s6\">Sonu\u00e7 olara<\/span><span class=\"s6\">k kiraya veren, konut veya \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda k<\/span><span class=\"s6\">iralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri <\/span><span class=\"s6\">gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa<\/span><span class=\"s6\">, k<\/span><span class=\"s6\">iralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise<\/span><span class=\"s6\"> ve son olarak k<\/span><span class=\"s6\">iralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa<\/span><span class=\"s6\"> ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abilir. \u0130htiya\u00e7 nedeniyle tahliye davas\u0131n\u0131n a\u00e7\u0131labilmesi i\u00e7in belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde 6 ayl\u0131k kira d\u00f6neminin bitiminden en az 3 ay \u00f6nce fesih bildiirminde bulunulmak \u015fart\u0131yla kira d\u00f6neminin bitimi itibariyle birlikte 1 ay i\u00e7inde, belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde ise s\u00f6zle\u015fme s\u00fcresinin bitiminden en az 15 g\u00fcn \u00f6nce fesih bildiriminde bulunmak \u015fart\u0131yla kira s\u00f6zle\u015fmesinin bitimi itibariyle 1 ay i\u00e7erisinde dava a\u00e7\u0131lmak zorundad\u0131r.
