Kanun m. 4\u2019te s\u00f6zle\u015fmeli personel say\u0131lacak ki\u015filere ve istihdam \u015fekillerine ayr\u0131nt\u0131l\u0131 olarak yer verilmi\u015ftir.<\/p><p><strong>\u0130\u015f sonu tazminat\u0131<\/strong>, s\u00f6zle\u015fmesini fesheden veya s\u00f6zle\u015fmesi feshedilen s\u00f6zle\u015fmeli personele mevzuatta yer alan baz\u0131 \u015fartlar\u0131n olu\u015fmas\u0131 halinde verilen bir tazminatt\u0131r. \u0130\u015f sonu tazminat\u0131 bir nevi i\u015f\u00e7inin k\u0131dem tazminat\u0131n\u0131n s\u00f6zle\u015fmeli personele uyarlanm\u0131\u015f hali olarak d\u00fc\u015f\u00fcn\u00fclebilir.<\/p><p>S\u00f6zle\u015fmeli personele hangi ko\u015fullarda i\u015f sonu tazminat\u0131 \u00f6denece\u011fi \u201cS\u00f6zle\u015fmeli Personel \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131na \u0130li\u015fkin Esaslar\u201d adl\u0131 Y\u00f6netmelikle d\u00fczenlenmi\u015ftir.<\/p><ul><li>\u0130lgili Y\u00f6netmeli\u011fin 7. maddesi gere\u011fince;<\/li><\/ul><p>Kamu kurum ve kurulu\u015flar\u0131n\u0131n yurt d\u0131\u015f\u0131 te\u015fkilatlar\u0131nda\u00a0s\u00f6zle\u015fmeli\u00a0olarak \u00e7al\u0131\u015ft\u0131r\u0131lan yabanc\u0131 uyruklu personel ile haftal\u0131k \u00e7al\u0131\u015fma saati s\u00fcresi 40 (k\u0131rk) saatin alt\u0131nda bulunan personel (Milli E\u011fitim Bakanl\u0131\u011f\u0131nda norm kadro sonucu ortaya \u00e7\u0131kan \u00f6\u011fretmen ihtiyac\u0131n\u0131n kadrolu \u00f6\u011fretmen istihdam\u0131yla kapat\u0131lamamas\u0131 hallerinde s\u00f6zle\u015fme ile \u00e7al\u0131\u015ft\u0131r\u0131lacak \u00f6\u011fretmenlerde 40 saat \u015fart\u0131 aranmaz)<sup>\u00a0<\/sup>hari\u00e7 olmak \u00fczere,\u00a0kurumunda fiilen, askerlik ve do\u011fum d\u0131\u015f\u0131nda kesintisiz en az 2 hizmet y\u0131l\u0131n\u0131 tamamlayanlardan;<\/p><ul><li>5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu gere\u011fince s\u00fcrekli tam i\u015f g\u00f6remezlik geliri, mal\u00fbll\u00fck veya ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 ba\u011flanmas\u0131 veya toptan \u00f6deme yap\u0131lmas\u0131,<\/li><li>Hizmetlerine gerek kalmad\u0131\u011f\u0131 i\u00e7in s\u00f6zle\u015fmesinin feshedilmesi veya yenilenmemesi,<\/li><li>\u0130lgilinin ek 6 nc\u0131 maddenin ikinci f\u0131kras\u0131 uyar\u0131nca s\u00f6zle\u015fmeyi feshetmesi,<\/li><li>\u0130lgilinin i\u015fe al\u0131nma a\u00e7\u0131s\u0131ndan gerekli olan niteliklerden herhangi birini sonradan kaybetmesi,<\/li><li>\u0130lgilinin \u00f6l\u00fcm\u00fc,<\/li><\/ul><p>hallerinden birinin ger\u00e7ekle\u015fmesi sonucunda s\u00f6zle\u015fmesi sona erenlere i\u015f sonu tazminat\u0131 \u00f6denir.<\/p><p>\u0130\u015f sonu tazminat\u0131 alabilmenin \u00f6n ko\u015fulu kesintisiz en az 2 y\u0131ll\u0131k hizmetin bulunmas\u0131d\u0131r. 2 y\u0131ll\u0131k hizmet s\u00fcresini dolduran \u00e7al\u0131\u015fanlar di\u011fer \u015fartlar\u0131n da varl\u0131\u011f\u0131 halinde i\u015f sonu tazminat\u0131na hak kazanacaklard\u0131r.<\/p><p>S\u00f6zle\u015fmeli personelin s\u00f6zle\u015fme ko\u015fullar\u0131na uymamas\u0131 nedeniyle kurum taraf\u0131ndan, s\u00f6zle\u015fme esaslar\u0131 d\u0131\u015f\u0131nda herhangi bir nedenle \u00e7al\u0131\u015fanlar taraf\u0131ndan, s\u00f6zle\u015fmesinin feshedilmesi veya yenilenmemesi hallerinde, i\u015f sonu tazminat\u0131 \u00f6denmez.<\/p><ul><li>5393 say\u0131l\u0131 Belediye Kanunu m. 49 gere\u011fince;<\/li><\/ul><p>Belediye ve ba\u011fl\u0131 kurulu\u015flar\u0131nda, norm kadroya uygun olarak \u00e7evre, sa\u011fl\u0131k, veterinerlik, teknik, hukuk, ekonomi, bili\u015fim ve ileti\u015fim, planlama, ara\u015ft\u0131rma ve geli\u015ftirme, e\u011fitim ve dan\u0131\u015fmanl\u0131k alanlar\u0131nda avukat, mimar, m\u00fchendis, \u015fehir ve b\u00f6lge planc\u0131s\u0131, \u00e7\u00f6z\u00fcmleyici ve programc\u0131, tabip, uzman tabip, ebe, hem\u015fire, veteriner, kimyager, teknisyen ve tekniker gibi uzman ve teknik personel y\u0131ll\u0131k s\u00f6zle\u015fme ile \u00e7al\u0131\u015ft\u0131r\u0131labilece\u011fi ve bu personel hakk\u0131nda bu\u00a0Kanunla d\u00fczenlenmeyen hususlarda vize \u015fart\u0131 aranmaks\u0131z\u0131n 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun m. 4\/b\u2019ye g\u00f6re istihdam edilenler hakk\u0131ndaki h\u00fck\u00fcmler uygulanaca\u011f\u0131\u00a0h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p><p>Belediye Kanunu m. 49 kapsam\u0131nda Belediyede \u00e7al\u0131\u015fan s\u00f6zle\u015fmeli personeller de 657 Say\u0131l\u0131 Kanun 4. maddesinin B f\u0131kras\u0131na g\u00f6re istihdam edilenler hakk\u0131nda uygulanan h\u00fck\u00fcmlere tabiidirler. Belediyelerce istihdam edilen s\u00f6zle\u015fmeli personelin, i\u015f sonu tazminat\u0131n\u0131n d\u00fczenledi\u011fi \u201cS\u00f6zle\u015fmeli Personel \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131na \u0130li\u015fkin Esaslar\u201d adl\u0131 Y\u00f6netmelik h\u00fck\u00fcmlerinden faydalanabilece\u011fi Belediye Kanunu 49. Madde incelendi\u011finde anla\u015f\u0131lmaktad\u0131r.<\/p><p>Dolay\u0131s\u0131yla, Belediye Kanunu 49. madde h\u00fckm\u00fc incelendi\u011finde belediyelerce istihdam edilen s\u00f6zle\u015fmeli personeller yukar\u0131da a\u00e7\u0131klam\u0131\u015f oldu\u011fumuz \u015fartlar\u0131 ta\u015f\u0131malar\u0131 durumunda i\u015f sonu tazminat\u0131na hak kazanacaklard\u0131r.
